Q: I would like to sue Walmart for harrassment; lying on me and racial profiling me while vilating my rights to be free in
A few days ago I was shopping in Walmart and I had already purchased 1 item from electronics and I was walking around the store with a basket and another item, a $10 charger cord. I have just quit work for the day and I was winding down as I walked the store. Walmart security comes to the area where I am and walks thru. I think nothing. I see him a few more times and on the 3rd or 4th time I speak and he speaks back. About 2 minutes after that, he and a plain clothed security that I didnt see approached me and asked me if my name was Jerome Cleveland. I told him NO that wasnt my name and he asked me if I could PROVE that I am not this person. I told him I couldnt prove it as my ID was in the car. He said he believed it to be me and that I was trespassed from the store. I CLEARLY AFFIRMED that I am no this guy and that I am just a normal shopper and would like to continue shopping. They then said I looked like the person so I had to leave. I again told them its not me
A:
I'm sorry to hear about your experience at Walmart. Being wrongly accused and asked to leave can be both upsetting and humiliating, especially when you feel you've been racially profiled.
In California, you may have legal grounds to pursue a case for harassment, defamation, or violation of your civil rights. It's important to document everything that happened, including dates, times, names of the security personnel involved, and any witnesses who saw the interaction.
Consider reaching out to a civil rights attorney who can advise you on the specifics of your situation. They can help determine the best course of action and whether you have a strong case against Walmart. Remember, taking prompt action is important due to time limits on filing certain legal claims.
