A:
In California, you have several options to compel the production of documents when opposing counsel isn't cooperating.
First, send formal discovery requests using the proper forms (Form Interrogatories, Request for Production of Documents, etc.) by certified mail. Keep proof of service and delivery. If they don't respond within 30 days, you can file Motion to Compel Discovery with the court, which may result in sanctions against the non-complying party.
Regarding the proof of service issues, you should immediately file Notice of Non-Receipt of Service with the court. You can also request proof of service for each document they claim to have served. If this continues to be an issue, consider filing Motion for Order to Show Cause regarding the opposing counsel's conduct. Remember to document everything - keep copies of all communications and attempts to obtain these documents. The court takes discovery violations seriously, and judges often look unfavorably on attorneys who ignore reasonable document requests.
