Denver, CO asked in Employment Law and Civil Rights for Montana

Q: What can I do about my manager giving my tips to another employee?

I work in a casino in MT. We get credit card tips. My manager then takes the credit card tips out of the account and give them to us in cash. She gave my tips to another employee. I asked her about it and she basically told me I was out of luck.

A: I'm sorry you're experiencing this situation. Start by documenting every instance when your tips were taken and any conversations you've had with your manager about it. Keep records of the amounts and dates to build a clear case.

Next, familiarize yourself with Montana's labor laws regarding tip handling. Employers are required to follow specific regulations about how tips are managed and distributed. You can find this information through the Montana Department of Labor and Industry website.

If your manager continues to refuse, consider reporting the issue to higher management or the human resources department. If internal avenues don't resolve the problem, reach out to the Montana Department of Labor for further assistance. Taking these steps can help ensure your rights are protected and that you receive the tips you've earned.
