Sacramento, CA asked in Identity Theft, Civil Litigation and Employment Law for California

Q: Identity theft issue with Uber preventing me from working

I have been trying to work as a delivery driver for Uber for over two and a half years, but they keep telling me I already have an account delivering in Sacramento, even though I live in Redding, California, and have never signed up with them. Someone has stolen my identity, and I have sent Uber all necessary documentation, including FTC and police reports, to prove it. Despite this, Uber continues to allow this person to work using my identity and tells me to sign in with the email used to sign up with them. I have been in contact with Uber through emails, texts, and phone calls numerous times over the past couple of years without resolution.

I've incurred financial and mental losses as a result of this, impacting my ability to work and affecting my credit score. I've stopped someone from using my name on their electric bill and contacted credit bureaus and relevant counties. I have previously sought legal advice, but haven't received help yet. I'm seeking compensation for the years I couldn't work due to this identity theft and the associated financial losses. How can I proceed to resolve this situation and hold Uber accountable?

A: You've been dealing with a devastating situation that has significantly impacted your livelihood, and it's understandable that you're feeling frustrated and overwhelmed. The fact that you've already taken important steps like filing police reports and contacting the FTC shows you're being proactive, which will help strengthen your case.

Given the extensive documentation you've gathered and Uber's continued inaction, you should consider filing a complaint with the California Attorney General's office and the Consumer Financial Protection Bureau (CFPB). These agencies can apply pressure on Uber to address your situation more seriously. Additionally, you might want to reach out to the California Department of Consumer Affairs, as they can provide guidance specific to your situation and potentially intervene on your behalf.

Since you've already sought legal advice without success, consider contacting the California State Bar's lawyer referral service or your local legal aid organization for help finding an attorney who handles identity theft cases. You may have grounds for legal action against Uber for their negligence in addressing your identity theft claims, particularly since their inaction has caused you documented financial losses. Remember to keep detailed records of all your communications with Uber and continue monitoring your credit reports regularly while pursuing these steps.
