You can file a claim with the city. Do this quickly. You can then file a lawsuit against the city and tow yard.

Your lawyer wouldn't "press charges." The prosecutor would file criminal charges. If your attorney failed to file a lawsuit and it is now time barred contact an personal injury attorney.

An attorney will need to evaluate the entire situation to determine whether it was an illegal search. You apparently think because you parked and were walking away from the car it was off limits. I am not sure a judge is going buy it.

Q: Does a Crim/Traf Non-Mand (fishing without a license) stay on your record if paying the fine.

My son received a ticket Crim/Traf Non-Mand (fishing without a license) while in fish house with two other friends. He did not have a pole in his hand but 3 lines were in the water. DNR gave him a ticket for 97C.301.2. The DNR say if he pays the fine it will not be on his record. Is that accurate?

Typically paying a citation will create a record. However, if this is a petty misdemeanor, that is considered non-criminal. If he wants to keep it off of his record, he should consult with an attorney. There are ways to keep these things from becoming a conviction.

You could always petition the court for an order that would prevent him from smoking around the child or be in violation of the order. Frankly, I'm unsure what the odds of success of such an order might be.

Q: Can I hand a handwritten letter directly to a Judge? Or a Judge Clerk?
