Child support is always modifiable. If you file for a modification the court will look at each parent's current income to do the new calculation. It is possible that the court will take the family health insurance premium and figure out what portion is paid for your children only. It does not... View More

Q: I have full custodian of my son I make 73,000 and his father is self employed. I pay for his medical expenses.

He takes him every other weekend or whenever he wants can I have a case of child support?

Child support is the right of every child in Florida. You do not mention whether you are divorced or if it is a paternity case. Either way you can file for child support.

Q: My fiancee's last child is about to turn 18 in about 30 days Located in Rhode Island, we live in Florida.

We were wanting to get married (After he turned 18 and falls off the currently owed) but didn't know if they they would either

A. make him pay more in arrears,

B. ask me to pay the arrears,

You can return to court with your ex and tell the Judge that they are willing to waive the arrearage; however, there is no guarantee that the judge will accept the agreement.

Yes, child support and visitation are not dependent upon each other; he still has to pay child support. His option is to seek a court order allowing him visitation.

Q: Do I keep paying child support (ASUME) if my daughter goes to college in Puerto Rico?

I live in Puerto Rico and so does she. She is 17 right now and will be graduating from High School and attending College in August. She will be 18 in November.

If it is a Puerto Rican child support order, you should ask this question in Justia › Ask a Lawyer › Puerto Rico › Child Support ›. If it is from a Florida court, and the order is silent about attending college, no, you would not continue to pay child support after her 18th birthday.

As long as the Department of Revenue is not involved you can agree to a lesser amount and close the matter. If DOR is involved then you must get their permission.

Yes you can claim your personal medical insurance as an allowable deduction. There is a spot in the very beginning of the Financial Affidavit for your medical insurance not the children. Look at the Financial Affidavit and read it carefully. Hope this helped. Good luck.

Q: My ex gets $2880 monthly, I get $900. The number of overnights he help the kids is 48. No medical insurance no daycare

Expenses. I tried using the online calculators and they are all around$940 .can I use that number to get to an agreement or is not valid.

No one is going to check or challenge your numbers. If you have done the calculations and you both agree to the number then you can agree. Child support is always modifiable until the child turns 18 so if there is an error it can be corrected.

You have not indicated if a Florida court has ordered that he pay child support. Assuming that one has not, child support ends when she turns 18.

The judge is not going to check it. Ask to see the worksheet in advance. You can look for a lawyer that will give you a free consultation and verify the numbers. You can file for child support after you and the child have made Florida your permanent residence for more than six months. You are not required to have an attorney but you may find it helpful.

The issue of child support is not connected to the issue of visitation. If you are liable for child support you cannot lawfully avoid it by saying you can't see the child. File something in the court having jurisdiction; the mother may have violated the divorce decree by moving to Georgia.
