Since January 2013 Central Mortgage Company of Little Rock, AR has been returning my brother's mortgage payments, checks uncashed/undeposited and now they are foreclosing because he is "delinquent" on his mortgage

In order to answer this question we need to see the record of payments that he has and the foreclosure suit papers. Yes, they can actually do this, but he might have some very valid defenses and a way to completely beat the mortgage company.

Well you have to pay rent to someone who now owns the home or who will own the home through probate or a trust. Find out if a probate has been filed and pay the personal representative.

You will probably need to consult with an accountant as to the best road to take taxwise. The trick is that although you say it's most recent fmv is 160, it is probably much less than that.
