What are the facts? This happens all the time, doesn't it? It later can turn upon what the cop wrote in the police report. There must be objective criteria for the search. It cannot be just for looking suspicious. Suspicions have to be within certain parameters to become probable cause.

It depends upon what type of case it is. Jury trials do not apply in many cases. You have not given enough facts here. Is it a criminal case? You have to know what the ruling of the appellate court is to determine what the next step is. It can take years.
