The penalties are as severe as an adult being caught driving. while drunk. However, the threshold of proof is lower. The State has to show a less BAC. So, it depends on whether there is a BAC or not. Consult with a well-qualified DUI attorney for assistance.

Yes, they can stop you for even weaving within your own lane. It's absurd, but it is the law.

Q: I was pulled over on a 49CC scooter for not wearing eye protection. Got charged with dui. Can case be dismissed ?

I was pulled over not wearing eye protection on a 49 CC scouter n Henry County. It ended up n a dui and driving without a liscence..?? Is there a chance on getting case dismissed?? The officeremony gave a reason that is a TOTAL LIE TO PULL ME OVER?? DO I HAVE A CHANCE AT A DIAMISAL??

If the basis for the initial stop is not a violation of the law you stand a very good chance of having the charges dismissed. I would recommend hiring a lawyer who regularly practices in that jurisdiction.

Q: My son has had 3 duis in Fl and had his license revoked about 10 years ago.

He moved to GA and about 1 year agao he was sitting in his truck about a mile from home. His keys were laying in the seat and a policeman came up and charged him with dui. Is there any way to get this reduced to another charge?

If the sentence has expired than the jail is unlawfully holding the person in custody and can be sued for false imprisonment.
