The judge is not legally required to consider the other children, unless there is a court order of support for them. The judge may consider the fact that you have other children in your household to deviate from the child support guidelines, but he/she is not required to.

If you are 18 you legally can move out, and law enforcement cannot stop you.

If you are homeless, leave the children with their mother, if the home is appropriate. If the home is not suitable, leave them with another extended relative.

It it is a Judgment, your neice needs to hire a custody lawyer to file for custody.

If it is a Custody by Mandate, it is only good for one year.
