I hope you have an answer to this question by now. Unfortunately, this question would probably go unanswered for years. There are not any criminal defense attorneys in your state who regularly answer questions on this forum. Get private counsel.

As is so often the case on this forum, you need to go see a family attorney about this. This forum simply does not allow the type of discussion about the issues that only a face to face meeting with an attorney can provide, in a confidential setting.

He has a record but all his charges are closed. He's never been arrested for this before. His sister said he choked me. I said he didn't. There's no marks on me., but they took him to jail anyway. Will he get out on his own or will they make him go to jail or will bail be posted?

All I see in what you have written is conclusions, no facts which would cause me to believe that the conclusions are correct. When you believe that a crime has been committed, you should report it.

This person committed a crime. When that happens, the state prosecutes for the crime with a state or district attorney, a lawyer. That lawyer represents the citizens of the state. You are a victim of crime. See if there is a victim advocate at the local prosecutor's office.
