The Court would want you to have a custody order most likely.
Family was living in Canada, husband physically abusive, wife & kids escaped & now living in MA. Low income, younger daughter dealing with OCD & PTSD issues, need help with divorce proceedings, custody, need to prevent husband from contacting children.

How long have you been in Massachusetts and did husband live in Massachusetts at some point? There are complicated jurisdictional issues and I urge you to make an appointment with a lawyer to go over all of the facts.

As long as an order is in place, then he is responsible to pay that amount regardless of what his income is. He must file for a modification to actually modify his child support obligation.

We had our divorce in Massachusetts and the child support order was originally out of Mass but then she moved to Virgina with the kids in 2006 and has been there ever since.. So my question is can she come back to Mass and file for a modification when neither of us live here?

It is my understanding that she can come to Mass because that is where the original Order was placed, however, you can challenge the jurisdictional authority.
