I started to pull out of the Walmart parking lot when a car pulled out from a lot across the street and I had to brake. When I backed up to get out of the street, the car behind me was driving forward and my bumper tapped his. He overreacted and accused me of damaging his car that was obviously... View More

From your facts it does appear to be your fault, that is a Rule of
The Road Violation occurred. If you plead Guilty and pay the Citation, it will appear on your MVR. You may wish to hire a lawyer to represent you, so something besides a conviction might go down. Your Insurance Company... View More
I received an Automated Traffic Enforcement Notification of Violation - Speed. I was able to look at the ticket online and see it was where I let my sister borrow my car. But she denies speeding. I have heard that since it was a video collected ticket that I do not have to pay and I should just... View More

It is a Civil Claim for Debt, not a Criminal Charge. It is your choice, but it cannot go on your MVR, or put you in Jail. But Collectors can sue, hound you and execute any judgments against your property.

You have not stated what happened. But any conviction of a Rule of the Road Violation will result in points against your MVR for the last twelve months.
What am I expected to receive from the court. Other party cut me off, I had to hit breaks to prevent collision. Other party never stopped.

The Court may give you some relief, but will probably find you Guilty. It is possible that you will have to make Restitution. You may want to make a claim on your Insurance. With the Rule of Road Violation will come some points on your MVR.
If I'm not mistaking, it reads if I don't exceed over 55 mph, then I shouldn't have to pay. Am I reading this wrong?

No, you have not read the entire Statute. Hire a competent attorney to work the Citation out so it does not put Points against your MVR. Diversion or Dismissal with payment of costs would work out well for you.
My husband has traffic tickets ranging from 2 years to 17 years old, they say he needs to pay them all before reinstatement. However, I had some tickets that were only 5 years old that fell off and was reinstated. They are tickets like driving with no license and no proof of insurance.

The Statute of Limitations for Misdemeanors is one year to initiate the charge from the date of incident. If the Citation is issued, then the charge is made, and the outstanding charge can stay out there basically forever. You may go to each Court and attempt to try to dismiss the old... View More
I was told that if I show up for court and the officer does not my traffic ticket would be tossed out. This is in TN. Is that true?

Not at all. Sometimes other witnesses exist besides a law enforcement officer. And usually the Court will give the State more than one chance to put on proof of a crime. This is the reason you should be very humble in presenting your Motion to Dismiss for Lack of Prosecution. It is sometimes... View More

Without Liability Insurance you have violated the Financial Responsibility Laws. The Department of Safety can suspend either the Operator's or Owner's Driving Privileges, or both. You probably need to hire an attorney and demand an Administrative Hearing immediately. If you pay the... View More

Yes. The Children would probably have nothing to do with the Rule of the Road Violation unless the Officer knew you were distracted by Them. This Statute is usually given in connection with an accident.
I always drop my daughter off in the neighborhood next to her school in Shelby County, Tennessee so she can walk without having to go through traffic. However, this morning there was an officer outside who pulled me over and said that he would give me a ticket if I did it again. On the side of the... View More

It is not legal for you to park there, much less halt briefly, and let out or pick up a passenger. However a Parking Citation is rarely a Rule of the Road Violation, so it does not go on your Motor Vehicle Record for the last year. You do not acquire points against your Driving License.
I was driving home from college for the long weekend. Playing music too loud and not paying attention and then lights.. first ticket ever and really do not want to have my insurance rates go up because of this but I am not sure if I should go to court and if I do go to court I have no idea what to... Definitely go to Court on time, in proper clothing and act respectfully. You may be offered some type of Diversion such as a Class or Costs which will allow the Court to Dismiss or Reduce the Speeding Violation.
Even if you are Convicted, it may not make it to your MVR.

It is doubtful the General Sessions Judge will give you any Jail time. However you should hire a competent attorney to go to Court with you. It may be possible to Divert it or Dismiss it, with Costs paid. A conviction is certain to add points to your MVR for the last 12 months, which could... View More

Usually most applicable fill in blanks need to be annotated. But Officers make mistakes all the time and the Courts usually allow it. Even if you make a Motion to Dismiss, the Court can dismiss the Citation then have you stand there while the Court gets an Affidavit from the Officer to issue an... View More

No. But if the Kentucky Ticket goes down as a conviction, then it will probably show up on your Motor Vehicular Report for the last 12 months. This might affect you in Court for another Charge or raise your Insurance rates.
I called TN DMV (i do not know where the ticket was given, it was on a freeway) and they have no record of my name anywhere. I have a valid LA license that is clear. You will need to hire an attorney to check with the Court Offices in the Counties near the Interstate Stop in 2010. You also need a TBI Background Check. All of this could be completed in about two weeks from when you obtain competent counsel.
I was on the interstate. What will keep this off my record?

Always go to Court on a Speeding Ticket. The Judge may allow you some way to Divert a Conviction, or even Dismiss it. That Violation is a 9 mph over type which is not reportable on your last 12 month's MVR. But you should still try to get is Diverted or Dismissed. Do not be smart to... View More

The Officer will probably claim the paraphernalia was in plain view. But hire a competent attorney and prepare for a Preliminary Hearing. It is doubtful, but you might get Indicted. If so, then file a Motion to Suppress Evidence due to an illegal Search.
I am trying to renew my DL in CA after living here 4.5 yrs. TN has put a hold on my DL renewal.
