There is no requirement that I know of that requires the attorney to be physically present at the closing. By the time the closing occurs, the attorney should have reviewed all the documents already. Q: I bought a house a year ago and my girlfriend moved in. The house is in my name only. She recently moved out.

And she is now suing me. Does she have rights to my house? Also we used money from our joint account to pay for some of the closing costs.

Q: brother in law has been hiding his deceased wife's 2014 Lexus in my driveway for 2 years. How to get it police-towed?

brother in law filed a lawsuit against deceased wifes heirs, but that case will be dismissed august 31, 2017. Heirs have put the title of the car in their name and have posted car stolen to police.

Sounds more like a criminal law question, as you've been knowingly abetting him hiding stolen goods. Go see a lawyer.

Q: Can my girlfriend sue me for back rent for a house she stays in without my name on the lease?

My girlfriend is saying she is going to sue me for back rent of 2,500 for a residence I no longer stay at and my name is not on the lease, she also trying to sue me for a previous apartment that no rent is owed on.

Oral agreements are still valid. It comes down to proofs.

If you had an agreement with her to pay an amount, then you owe it to her. Sounds like you were living together, and you moved out. If you agreed to pay some or all of the rent, then you're likely on the hook to her....

Hire a good home inspector. Point out the areas of your concern to the inspector, so he can zero in on them. If you don't feel confident after the inspection, move on. There are plenty of houses out there.

Q: Is an NY residential apartment lease valid if signed but not dated, and if there's no signature from the landlord?

I'm not as sure as my colleagues. If you haven't moved in yet, and the landlord hasn't signed your copy, then the landlord hasn't yet accepted the terms of the lease. In that case, you can cancel.

However, if you have moved in, then there is at least a tenancy created....

You need to notify the landlord in writing, certified mail, RRR, of the problem. Advise the landlord that you will provide them with a reasonable time to fix the problem, or you withhold rent from the date of the letter until it is fixed. The bad news is your landlord can evict you if he wants to personally occupy 1 of the 2 units in a two family home.

The good news is that he is bound by the terms of the lease. Therefore, he can't evict you until your lease expires.

If you had a written lease with your old landlord, check the terms of that lease to see what the notice requirements were. The terms of an expired lease which has converted to a month to month still remain in effect, other than the lease term. Both you and the new owner are bound by that.... View More
