Q: I have a speeding ticket in nyc, Ny licensed Driver I’m in the process of moving to California, will I have to come back

I was just wondering if I need to come back to ny for the court appearance if I will be licensed in California

If you want to fight the ticket yourself you will need to come back for the hearing. If you hire an attorney to fight your ticket you don't have to come to the hearing.

If the traffic ticket was issued to the car, like a parking ticket, you do not receive points on your license.

If you receive a ticket for not having a license, there are no points, but the conviction appears on your driver's license history.

Thats a good question. Some judges will dismiss based on that and some will not.

Hi,

It really depends where you received these violations. If they were in the 5 boroughs, the only thing that can be done is pay the fine. If they were from a different court, then it is possible.

Q: Should I plead guilty to a 3752A?

Pulled over for speeding, officer let me off but gave me a 3752A saying he couldn't see my headlights. It was 3:15pm with light snow, but my automatic headlights indicated they were on. Seems like an easy not guilty plea, except court is 6 hours away.

This could be a 2 point ticket. Some courts allow you to ask for a reduction by mail. In other cases you will need to send an attorney.

Could be either 2 or 3 points, depending on what violation code they used.

Q: My ticket has been dismissed. Do I still have to go to court. The ADA says I do not have to appear. Is this correct?

I was driving a ambulance in a emergency response,had to backup at a scene and the car behind me was so close I could not see itin any of my mirrors. I did minor damage to his car,broken plastic bumber. He also complained of a knee injury. I was stopped,backed up less than a foot.

If your ticket was dismissed then you don't have to appear.

Court is in Austerlitz NY. Will they let me plead guilty to a lesser charge through Mail or over the phone.

Q: How to I pay traffic ticket

I got pulled over for not having a front license plate and I am going to plead guilty by mail. However,no fine was listed on the ticket itself and it clearly stated that one would be assigned to me. Will this fine come in the mail after I send in my ticket and they review it??

If you plea guilty the judge will pick a fine from a range of possible fines.

Beware, this conviction will be recorded on in New York State DMV driving record system.

not a good idea, even though it is a 0 point violation, it stays on your record for 4 years. Depending on the Court you may be able to reduce it to another 0 point violation that will not appear on your record.

We have a lot of success with these types of violations.

Q: I was pulled over for suspended registration, I had no idea. Fixed it. Now what should I expect?

I was pulled over for suspended registration. I never had notice from the DMV, or insurance company that my insurance had lapsed. I went down to the DMV the next day and paid the civil fees. I have court tomorrow morning for the ticket. What can I expect? I’m terrified.

This is a criminal charge. Usually the fact that you fixed the registration issue is not a grounds to dismiss the charge but it is a reason the prosecutor may offer you a plea deal.

In New York a fine isn't posted on the ticket. If you plead guilty the judge would need to choose a fine from a range.

Unless you were arrested and quested, the police did not have an obligation to read Miranda.

If there was a traffic camera (as opposed to a security camera) you will receive a fine notice in the mail. That type of ticket does not carry any points nor does it affect your driving record.

Q: Is it legal to suphena a ticket from 11 months ago?after already been fighting a ticket from the same accident.

11 months ago I was given a seatbelt ticket during an accident the cop hadn’t been to the scene until 20 minutes of me being out of my car so I fought it in court the day of my trial the cop provided me with a ticket for failure to yeild during a right turn and had dropped the seatbelt ticket.

Yes you can use this as a defense. Just to note: in the 5 boroughs all traffic violations go to trial, and therefore, the only possible outcome is either dismissed or guilty.

Not likely. They want to suspend your license, you already appealed and lost.
