The letter requests I see someone for a Pre trial. The ticket was issued in November 2015 and I sent back a not guilty plea right after I received it. I just got a letter in 2018 for a Pre trial!

If you waited more than 2 years you can file a motion to dismiss pursuant to People v. Thorpe, 160 Misc.2d 558, 613 N.Y.S.2d 795 ( App. Term, 9th and 10th Judicial Districts, 1994).
My husband had a minor fender bender, both vehicles still drivable and no one was injured. My husband was ticketed for "following too closely" the officer marked the ticket as Traffic Infraction and also Arrest Type as 6-Personal Injury. My husband had explained to the officer that he was... View More

"arrest type" on the ticket form refers to why the officer encountered with the motorist. It does not mean there was a formal arrest.
The officer might report your husband to the NYS DMV Medical Review Unit, which will require him to submit paperwork from a doctor showing that he... View More

The 18 month DMV counting period, for the purposes of suspending your driver's license, counts from the date of violation, regardless of the date of conviction. We hear that insurance companies count from the date of conviction.

The misspelling of the name has an argument that its invalid. The argument won't be accepted everywhere. If the ticket is dismissed the officer can issue a new ticket.

You can hand in the plates at any time, but keep the receipt for having forfeited them.

If the suspension went into effect for a valid reason, it will be very difficult to remove.

Surely you are not handling a criminal case on your own. Either you hired an attorney or the court appointed an attorney for you. Ask that attorney how this subsequent charge might affect your case.
If you told the judge you don't want a lawyer on your criminal case, go back to court... View More

If the car is registered to you, the tolls are chargeable to you. You can go after the driver in small claims court.
I am international student, studying on f-1 visa in USA, I don't have a US driver licence, instead i was driving with my Indian driver licence, and the officer took those details and gave me a ticket. What should be my next step?

Non criminal traffic violations should not affect your Visa status. As far as the tickets go, if you ignore them and you continue to drive, they will arrest you and charge you with a crime.
You should either plead guilty, or plead not guilty, and fight the tickets. You may hire an attorney... View More

Yes, and they can issue a suspension against you using your name and date of birth, should you fail to answer.

You can certainly fight your ticket but an incorrect address isn't going to get your ticket dismissed.

Hello Isaac,
That is not enough to get the ticket dismissed. If the ticket has your drivers license number on it the dmv can trace it back to you. Where did you get this ticket. You can contact us if you need more help.
Happy New Year.

For moving violations most courts accept the not guilty plea by the UPS date stamp date. So the answer to your question would be no. Parking tickets maybe different depending on the agency.

Are we talking about a orange, yellow or pint ticket?
The complainant needs to sign, does not need to print.
Can I still get points if found guilty?
answered on Dec 21, 2017
Yes, you will receive 3 points if you are convicted at trial. What those points do for you, is a complicated story.

Hi,
A moving violation such as unlicensed driver is on the driver not the car. It will only affect your husband's insurance if his father is considered one of the insured drivers on his policy

I am not following at all. Where was the ticket filed?
If you plead guilty, why is there a hearing date set?
I have since moved, surrendered NY license and have license in new home. I am applying for a driving job and not sure if I should report this on application considering that I do not think it is on record yet. Lawyer does not respond to my inquiries

The only place to put a reason on the ticket is in the plea of guilty. You don't want to do that.
Please not guilty and go into court to work out a deal on a conference date, or go to trial.
You can also send an attorney.

The strategy and process depends on the court. Where are these tickets filed?
