Them anyway. If I signed custody over can they give it back w/o DSS/CSP involment

if you give grandparents custody and want children back (and grandparents will not agree) you would have to file a motion with the court that entered the order granting your children asking the court to order the return of the children.

depends on what the documents regarding guardianship says and if you have guardian over the minor's financial (instead of just his/her person). More information is needed to fully answer.

Congratulation! You would have to file a Request for name change, post a publication of the request, then have a hearing as to why it is in your child's best interest to have his name changed.
His dad has joint custody but he hasn't been involved in this custody situation this time around.

Its a hard burden for the grandmother to prove to be successful, but if she is able to prove that both you and the father are either unfit or exceptional circumstances arise, then it is possible, if the court believes it is in the child's best interest to be with her. However, if she cannot... View More

It can be. You should file immediately. Retroactive child support cannot be granted (if at all) prior to the date of filing

Why do you think that they would get kicked out of the military for cheating? I have represented both sides of a military spouse cheating and have never seen anyone get kicked out because a spouse filed for divorce under a claim of adultery.

The police will only do a welfare check with the facts that you presented. If the children are fine, they will not remove them from the father. You would do well to schedule a consultation with an attorney ASAP and file for custody ASAP

Depending on the order (or agreement) reached by your fiance and the father of the child, will determine what effect where you and your finance live (or may live) on any future modifications that may be filed due to a move. The fact that you are getting married, in and of itself, should not effect... View More

Do I file in MD or where my child was born?

If you have lived here for more than 6 months, with the child. Then go to your local Office of Child Support Enforcement Agency. For a cost of $25 they will file a Paternity and Child Support action on your behalf. If the father files an action for custody, depending on the county you are in, OCSE... View More

if you are fearful of immediate harm to yourself or your daughter you can file for a protective order. If you don't (or even if you do) you should file for custody. You would do well to schedule a consultation with an attorney to know all of your rights and options (after an attorney asks... View More

What type of "valid agreement" would be needed to exclude property that would otherwise be considered "family use personal property"?
answered on Jan 7, 2015
It depends. In theory, anything written down and signed by the parties is considered a "valid agreement." Will this "agreement" actually protect the parties if a party tries to invalidate the agreement or not follow it, depends on what is written in the agreement. Having an... View More

Until there is a court order stating otherwise, you both have an equal right to the child. You can file for custody and child support in the circuit court in the county you reside in. With the little facts you presented it will be hard for him to be successful in obtaining primary custody. This... View More

Are you looking for access to the child? If so, the fact you are paying child support is irrelevant. Is there a court order in place? If so, what does the Court order say regarding access? If so, is he comply with it? If not, file for contempt. If no Order is in place, you should file for... View More

Is it a court order 50/50 custody? What are the parties income? What daycare expenses are there? Who is paying the health insurance premium for the child?
