Hello Asker,

I would recommend that you contact an attorney. This is a very serious ticket which will likely carry a very hefty fine if you plead to it as is. Additionally, you will be COMPLETELY unable to receive court supervision without an amendment to the ticket to a lower level...

I recently received a ticket for going 26 mph over the limit in woodford county. I know this is now considered a class b misdemeanor. My driving record is otherwise good. I'm trying to figure out if i need to consult an attorney given this new classification? Also wondering if court... View More

Hello Asker,

First, I must emphatically state that court supervision is NOT legally possible for speeding offenses over 25 mph over the limit under 730 ILCS 5/5-6-1(q) if that is the offense you are sentenced to. That said, it isn't technically impossible to receive court supervision...

Q: 2 tickets in 24 months. How can I stop my license from being suspended?

I got a Failure to Yield in 2013 (Coles County) and an 83 in a 55 in 2014 (Douglas County). My license is now being suspended for a year. What are my options to avoid this?

Hello Asker,

The reason you are suspended, or rather pending suspension, is because these are both moving violations. If you receive two convictions in a 24 month period for moving violations while under 21 years old, you will be suspended. The actual length of the suspension is...

Hello Asker,

You are facing a ticket for an offense that is a class A misdemeanor. It is punishable by up to a year in jail and/or a fine up to $2,500. Additionally, this speed is, by statute, not eligible for court supervision meaning that it is VERY likely to negatively impact your...

It wouldn't be a bad idea to at least schedule a consultation. When it comes to traffic accidents, the main concern is ensuring you do not face civil liability for the accident and minimizing this risk. For this reason, it is advantageous to have a traffic attorney assist you in resolving... View More

answered on Jul 6, 2015

No, this is not a sufficient basis for throwing out the ticket. Much of the identifying information on the ticket is still correct I presume. The only way such an argument would work is if there was a true question as to mistaken identity. Such would be the case if there was incorrect license... View More

First, you will be fine. If this is your first ticket, you shouldn't have any trouble and truth be told, you shouldn't need a lawyer either. You will be given the option to plead guilty or not guilty. If you plead guilty, the judge will sentence you. If you choose this option, I... View More

No, you cannot have that documentation removed from your record. Understand though that to all eyes that view these records, they understand what that means. The principle purpose of the record that it was dismissed and closed is to show that you were issued a ticket and that the case against you... View More

Q: I received the first ticket in my life for disobeying a stop sign. I have a CDL. Can I still get court supervision?

Also, will I have to take a test when my license comes due in 2017?

First, nothing about having a CDL will EVER prevent you from getting court supervision. This much is true. The issue facing CDL drivers is not whether or not they can get court supervision, but rather what impact it has on them. As far as the federal reporting agencies are concerned, court... View More

No, you do not have to worry about a fine being assessed against you. The option to pay the ticket for a fine is a mechanism that allows you to avoid court appearances and request court supervision or a conviction (for a lower fine). Failing to do this or mail the ticket back pleading not guilty... View More

Q: If a ticket I got over a month ago is not online for me to pay it does that mean it is not filed and I can fight it?

Ticket was for following too close and then a warning for going 5mph over the speed limit from a IL state trooper. Have checked online and called multiple times to see if ticket posted online yet and hasn't. If the ticket is not filed can I get off not paying it?

I have only seen this happen a few times and it is a rather frustrating matter to deal with. My recommendation would be to visit the clerk of the circuit court clerk of the county where the ticket was issued. That is where a court date, if any, would be scheduled. I would be particularly... Q: Is there a rule about the time between traffic school completion and the next traffic violation?

When I was 20 I received 2 traffic violations (speeding 15 mph over the limit and a stop sign violation). I took an online traffic school course to remove the second ticket. Yes, this period you are thinking of is called court supervision. The way court supervision works is that it keeps a conviction from entering in exchange for a period of no new violations and compliance with payment of fines and other court orders. Ordinarily, this period lasts around 1 two 12... View More

No, if you paid a speeding ticket by mail, you have already made an admission of guilt and allowed the court to sentence you ex parte (not in your presence). You have also given authority over this decision over to the prosecutor if you requested court supervision. If you did not request court... View More

First, DO NOT MAIL IN THE TICKET! In my experience with the DuPage County State's Attorney's Office, requesting court supervision by mail is VERY likely to result in a conviction if you had a previous ticket within the last 12 months. For this reason, it is very dangerous to mail in the... View More

Going to court without speaking to one (even if for a free consultation) is the easiest way to get on the path to jail as their experience may lead to better negotiating, chances to challenge the stop, and... First, this will prevent renewal as all fines must be paid in order to renew.

The good news is that when a fine is this large, it is VERY likely the result of either an ex parte conviction or bond forfeiture. Both of these can be corrected by taking the ticket back to court. Depending...
