He is covered under my health insurance, I was wondering can we still turn the injury into workers comp

This is something I witness on occasion. This is prohibited by Maryland Workers Compensation Law and, some, consider it to be fraud on the Employers part. Your son needs to speak with an attorney to discuss his rights. This should be a free consultation. There are many time limitations in... View More
I broken my fibula and dislocated ankle at work on 1/24/14. I had several surgeries since. I still have pain around my ankle on my right foot. I am not cleared to return to work, but at my last doctors appointment, an independent case manager sat in on my evaluation. She convinced the doctor to... View More

You need to consult a workers' compensation attorney immediately. There are a number of rights that the insurance company may be violating. As for the value of the case, an attorney will need to send you to a doctor for another ime. THis should not be set up by the insurance company. The... View More
I recently went for an IME concerning my MRI results to see a foot/ankle specialist. During the IME, the doctor injected me for with a nerve block. I explained I received one earlier the same week but he proceeded anyway. After 20 mins, the doctor can back into the office and started feeling... View More

This certainly seems like an odd scenario and I would call your attorney immediately. It is very unusual for an IME doctor to perform any kind of medical treatment. ordinarily the IME report will take about a week or so. Sometimes the release of the IME is delayed, inadvertently or otherwise.... View More

You lawyer is entitled to be paid for the work that he has put into your case. This is something that you should certainly discuss with your lawyer, in person.
I settled in maryland but the medical stayed open. I now live in florida and am having some serious issues, how do i see a doctor?

You are entitled to see an out of state doctor of your choice. The catch is that the Doctor must accept Maryland Workers' Comp fee schedule.

Ordinarily the checks will stop and no family member will have access to the money. In some limited circumstances the money will flow to your estate.
Company originally tried to make this a VA. case although im a multi state driver they lost jurisdiction to MD. In feb. Now they filed an appeal

Now that an appeal has been filed the case will get much more involved. There will be a discovery period where the Employer Attorney will be able to ask you written questions to which you must respond. The employer will be entitled to review documents that they were not able to review before the... View More

This is the battle that many workers' comp claimant have to endure. Quite often authorization is not given even when the doctor and you both know the need for the treatment is related to the work incident. Contact an attorney if you have not already.

The law does not clearly indicate whether you would be covered by workers' comp insurance if you were injured getting into your company vehicle while at home. More details would be needed.

You are entitled to treat with a doctor of your choosing as long as the doctor is willing to accept payment under the workers' compensation fee schedule. If you haven't talked to a workers' compensation attorney yet, it may be a good time to have one represent you. There are... View More

Whether an occupational injury is related to work is ultimately determined by the Workers' Compensation Commission after a hearing is held. I am sorry you feel appalled and used, but quite frankly that feeling is fairly common amongst those having to deal with workers compensation insurance.... View More
