Your best bet is to have a power of attorney that expresses your wishes and consent to (a) specific person(s) for guardianship in the event of your incapacity. Similarly a prefernece can be placed in your will in the event of death.

As a supplement to the other attorneys response, any defendant has the right to remove a case that was initially filed in a state court to a federal court if all parties have residence in different states and the value of the case exceeds $75,000. Otherwise, the right does not exist.

You can either proceed representing yourself or hire counsel. If you have any assets or debts to contest, own real estate or have minor children you should seriously consider consulting with an attorney. Good luck.

You may or may not be able to see the status of your divorce online, depending on what county your case is in. A chapter 7 will release you from marital and your own debts only, not him. The judge sees what information you present to him or her subject to the rules of evidence.

If he has dementia, you will likely have to be appointed as his guardian. Whether you can sue the hospital would depend on whether his fall was in any way related to improper care or whether there was a defect in the room that caused the fall.
