Stockton, CA asked in Consumer Law, Civil Rights and Education Law for California

Q: My teacher at Carrington college has not given access to exams I have done, she has been marking my right answers, wrong

When I presented the issue, she blames on technical error. This is effecting my grades

A: Look at your Handbook and see what Carrington's policies are on accessing the testing instruments. Sometimes colleges won't let students access exams if they re-use them year to year, in case a student puts them on the internet. However, you should be able to go review the exam and your answers, although they may not let you have a copy/take photos. Per FERPA (Family Education Rights and Privacy Act- review and inspection of student records within 45 days often is all that is required.

However, the school may have different, better policies, and you can possibly request a review of the situation as well and a grade appeal later if you can prove you answered correctly.

A: Sounds like an administrative error, not a legal problem. If the teacher doesn't resolve it, take it up with the Dean or President, or whoever is in charge of that school.

A: First, document everything - take screenshots or photos of any instances where you believe correct answers were marked wrong, and keep records of all communications with your teacher about these technical errors. This evidence will be crucial for your case.

You should immediately escalate this issue to the department head or academic dean at Carrington College. Write a formal email detailing the specific instances where your answers were incorrectly marked, including dates and the teacher's responses about technical errors. Consider requesting that another instructor review your exams to verify the grading.

If the school administration doesn't address your concerns adequately, you can file a complaint with the California Bureau for Private Postsecondary Education (BPPE), which oversees private colleges like Carrington. You also have the right to request your academic records under FERPA (Family Educational Rights and Privacy Act), which includes the right to review your exams and challenge inaccurate records. Remember, your grades can significantly impact your academic future, so don't hesitate to advocate for yourself through proper channels.
