In 1964 my great grandmother was shot and killed by a man who was having a psychotic episode that included hallucinations. He had been released from a mental hospital just a few days before. This happened in New Hampshire. Can the hospital be held liable for prematurely releasing him?

Unfortunately, the short answer is no. That is because of the statute of limitations. In other words, it's too late to bring a case as this happened almost 60 years ago.
If you were within the statute of limitations, this would have been a case worth investigating. If the hospital... View More
There were two orders in my file, one for my lower arm and one for my entire arm. They did the one for my lower arm. Two years later I had the test done at another facility, and they did the correct test that showed i had nerve damage.

A New Hampshire attorney could advise best, as elements such as statutes of limitations are state-specific in med mal cases. But your question remains open for two weeks. An issue that could arise is the extent of damages suffered as a result of not diagnosing nerve damage in the original test - as... View More

A New Hampshire attorney could probably advise best here, but your post remains open for four weeks. If you are currently represented by an attorney in the matter, discuss the dismissal in further detail with them. Additionally, since you mention mass tort, those cases sometimes span multiple... A New Hampshire attorney could advise best, but your post remains open for three weeks. What you describe involves the legal theory of failure to diagnose. Only a medical professional is qualified to determine whether a breach of medical duty occurred here. You could reach out to New Hampshire med... View More

I don't see a question here, but at this point first, being post op, you need medical treatment so without sounding like you are interested in suing anyone you can ask questions but in a very neutral way. Second, if you have PTS, look for an EMDR therapist. Google:

4 days ago. Apparently, 6 months ago when he went to ER for same symtoms the CT scan showed the rumor then only it was 1 cm smaller. We where never informed about the tumor then. Had we been told then it may have had a different outcome as far as dynamics of surgery or treatments. Is this something... View More

Yes. You should certainly talk to an attorney. This is a possible case of medical malpractice, though of course a lot more investigation is necessary.

Call an experienced malpractice lawyer if you think you may have a claim. Abramson, Brown & Dugan in Manchester have a reputation as the best in the state for medical malpractice. http://www.arbd.com/

On my yearly physical, I expressed concern to my doctor about a specific part of my body. And even if I am in... View More

If an attorney can get an expert to say that if the doctor had followed through would that have made a difference. It is hard to say without seeing the records because even if you tell him and he does something, by the time you have tests or studies to figure out what is going on a month could... View More

Small claims court is not normally a good venue for medical malpractice claims. An attorney would have to see the exact language of any document you signed. Have you tried getting a free consultation from a medical malpractice lawyer in your area?
Upon the second surgery a surgical towel was found and removed. Does he have a case of medical malpractice against the hospital?

Leaving items in a patient is generally a very strong signal of malpractice. Your Dad should talk to a NH medical malpractice lawyer to determine his rights and options.
