Q: what recourse is there for non replacement of passenger airbag after recall?

You can write a certified letter and send it to a corporate office at Ford's U.S. Headquarters, it will move the dealer to take care of your problem.

Q: Can I put Car Rental Fees on my Small Claims as part of Demand$?

I am taking Ford Motor to NJ Small Claims for paint being Defective on my car. Dec 04 Ford out out a Technical Services Bulletin advising their Service Depts. I purchased my car in 05 brand new and at that time knew nothing of any paint defects.

You can certainly add any legitimate claim to a lawsuit. However, even in Small Claims Court, you will find that Ford or the dealership will be represented by an attorney. You need to retain counsel and have the attorney send the dealer a letter. The contract you signed will need to be reviewed by a retainer, but it is unlikely that a waiver of the Lemon law will be upheld by a Court. Good luck.

Yes they can since the bank was not a party to the lawsuit and your obligation to the bank is "mostly" independent of the conduct of the dealer. But there are some sets of facts where you could sue the bank based on the warrantied performance of the car. It is called the holder rule.... View More

Engine siezed due to time belt falting

based on oil pressure , car repairs exceed book value of car or close to it

we ended up scrap car worth 6000.00

because repairs were 5,000.000 plus

do we have any recourse based on class action suit

Initially there is a problem if you no longer have the car. Before the car was disposed of by you you had to give the manufacturer or the dealer a chance to look at the car to defend themselves in a lawsuit.
