Q: Can I be issued 2 tickets for same offense on same day?

Received a ticket for parking too close to a fire hydrant at 4:48 am which I paid. Then just received a notice for another ticket, which apparently was issued at 8:16 am the same day. I did not receive this ticket and was not even aware of it until today. Do I have to also pay this one?

You should double check with the Court to make sure not a double listing. If not, it is possible to get 2 tickets for the same non moving violations. If that is the case, please pay same

Can this be used for moving vehicles?

The statute states "No person shall cease to hold the reins in his hands while riding, driving, or conducting a horse.". I AM NOT SURE how this applies to motor vehicles except for horsepower of a vehicle and keeping hands on the steering wheel.

Double Jeopardy

The Fifth Amendment to the U.S. Constitution provides, "No person shall … be subject for the same offence

Good Question, I believe the court would findthat since you are warned about it before by the law/regulation it is not double jeopardy.

Q: Is a 39:3-40 violation worth fighting or will a lawyer be too expensive. Suspension was for uninsured old car I junked

I was unaware I was suspended but that was only due to me not checking my mail in time. I took all the necessary steps to restore everything, but I am concerned about point penalties and my driving privilege being revoked

Are you restored now? 3-40 is a very serious charge especially if the underlying suspension was due to no insurance. If you have been restored, it can be reduced to a less serious violation relatively easily with a fine (and possible surcharge) only. If not, you may need to get a lawyer and gear... View More

Maybe, we would need more information to properly answer your question such as a picture of the intersection where you made the turn as the intersection may have other traffic controls such as a road line etc.

Sounds like you have a good defense for the ticket if what you say is true. But as they say their is two sides to every story so winning will also depend on what the officer will say.

It's hard to tell sometimes, but generally it is written in the law if they cannot stop you for the offense.

I was heading back home at 9am from class and an officer stopped me because according to him I was speeding which I wasn't. Yes a police officer can give you a ticket for something other than what they originally stopped you for. Also, the fact that the police officer put down the wrong color for your car is generally considered a clerical error and generally does not effect the validity of the ticket.

Sure you can plead not guilty and explain your situation to the judge but unfortunately it still means you are guilty based on what you said. If you want the best defense your best choice is to always hire a good lawyer to find a defense for you.

Unsafe Driving on a third offense is a 4 point violation, whereas Careless can be a 2 point. There is also the 97.2 which is an unsafe on the first time which is a Zero Point but a 400.00 fine. so it all depends on the situation

Q: If I get a speeding ticket in another state how many points will I get in NJ

I got a speeding ticket in Virginia, but I have a New Jersey License. I read a couple things that said the points will be transferred based on home state. So I was trying to figure out if it is just 2 points or the full 6 points that Virginia will give me.

As Virginia is part of the Motor Vehicle Compact (meaning reciprocal) you probably will get the full 6 points. Find an attorney to represent you in Virginia and get the points reduced if possible

Yes Failure to observe a signal is a 2-point ticket. The points will go on your license unless you fight the ticket at court and win.
