You are eligible for supervision. there will be a fine plus you will have to carry SR 22 for three years. if you take a conviction the fine will be less, your license will be suspended for 3 months and you will not have to carry SR 22

I'm not sure what you mean by "issued out of town" but something to keep in mind is that a Virginia summons should include your license #, your address, other identifying information, and (usually) your signature. I wouldn't assume that this error would prevent the charge from... View More

Do a lot of these cases where I used the defense of existing emergency or to avoid an accident. Clearly, the fact that you had a flat would create an emergency situation to support your defense and no violation had occurred. You can contest a ticket two ways. 1) Do it yourself: Call the court and tell them you would like to plead not guilty and wish to have a trial or 2) you can hire a lawyer to do this for you and your lawyer will conduct the trial with you in your presence at court. I would not worry about the fine its pennies compared to the cost of the 3 points on your CDL license that this ticket would give you. Reckless driving is a gross misdemeanor. Maxim penalties are up to 364 days in jail, and a $5000 fine. If found committed, he will also have a 30-day license suspension and a mandatory 3-years of SR-2 (high-risk) insurance to have a license.
