If you involved in a case, you can ask the judge for a jury trial (depending on the type of case). If it's a general policy concern, you can talk to your legislators.

A judge will normally say it a case is dismissed with or without prejudice. Sounds like the judge denied dismissal in this case, if I understand the question.
