She said she had to move due to not being able to afford the rent in the area that we live in and could get some help from family if she moved out of state.

She doesn't need your permission to move, but you have potential remedies to keep the children here. You should contact an attorney to discuss your options.

You didn't ask a question, but my advice is to file for divorce in Georgia ASAP. After she is gone 6 months Georgia will lose jurisdiction over the custody of your children.
This is for a child custody battle. I have no prior record and the request is not subpoenaed. Do I HAVE to answer? 9-11-26 and 33 says I have to answer but nowhere does it explain the boundaries for such questions. Wouldn't HIPAA override this request?
answered on May 19, 2021
In general, HIPAA doesn't apply to individuals. In a custody battle, most information is relevant, so you likely will have to answer.

Is the mother asking you to legitimize the child? Is she asking you to consent to the name change? Usually the person wanting the thing done is the person who would be filing the paperwork with the Court. We would be happy to discuss the issue further with you.
answered on May 13, 2021
Yes. Both have equal rights, so she can take the child to another state. If the father has an issue with it, he can file for divorce or separation.

You aren't required to respond to anything not related to children or business between you and him. You can respond just to the attorney about court related matters.

You don't have to go through child support enforcement. You can hire a private attorney to file for contempt.

My sons father has his sister in law as his lawyer and they are both falsifying information to the court. Isn’t this a conflict of resolution?

An attorney is allowed to represent a family member if they wish. No one is allowed to falsify information.

The child support owed is in Arkansas.

You will need to contact an Arkansas attorney to determine what collection remedies are available in that state. In Georgia, if there is a judgment for the child support, that can be garnished from a bank account.

This may not be possible. Zoom hearings are standard because of the pandemic. Judges are required to hold via zoom absent an emergency.
I gave birth to our son at the end of 2019. We ended our relationship in 2020 and he hasn't really contributed financially since then. I opened a child support case in January 2021, how long the does child support process usually take?
answered on Mar 10, 2021
How long the process takes will depend on his response. If he acknowledges paternity right away and is a w-2 employee with regular income, it can be a fairly routine process. However, if he requests a dna test or disputes the presumptive amount of child support requested, that may delay the... View More

If you have primary custody, you can claim the children as dependents. You can't do anything about the COVID relief money. If your ex owes you child support since September, you can file a contempt for that.
