A day before court in October 2018, the judge cancelled & I couldn't get another date for over a year! Now A week after I missed court because I never got a notice (due to an address error), the NCP called demanding the kids the same day bragging about a default judgment. I didn't... View More

Q: What form do I use to amend a child to an existing order?

Two kids are already on the legitimation paperwork. I had to wait until DNA confirmed the third child and now that it has, the judge told me to amend the third child in order to proceed with legitimating all three for the same order. I have looked all over for such a form and can not find one. I... View More

There is no form to accomplish this. If the case is still pending, you need to amend the petition or answer to add the third child to the action. If the action is no longer pending, you will need to file a new action for the third child or to modify the previous order to include the third child.... View More

Q: Is it supposed to say divorce on it if the parents was never married

Father filed for legitimacy and custody and visitation of child

If parents were never married there cannot be a divorce, therefore nothing should state “divorce.” It is best to consult an attorney who can review your case files and provide legal counsel about the specifics of your case.

Q: If my 16 year old got someone pregnant, what are the chances of my child support obligation being nullified?

I'm not just trying to get out of child support, but I know that I'll be the one to pay child support for my 16 year old's kid (not legally, but to keep him out of jail). 16yo's other parent is completely apathetic to the whole situation and only cares that I NOT stop paying child support.

You need to consult an attorney about filing for divorce and obtaining child support. You have said anything that would warrant a judge ordering supervised visitation, though.

There is no minimum time to go back; however $5.00 per hour is not going to result in a large increase so it may not be worth it. Once a modification is filed and an order entered, then there is a 2 year window before going back, so it's best to wait until a substantial increase can be proven.

Q: I have a support hearing for a child I was told was privately adopted.

I allowed my sister in law to "adopt" my baby straight from the hospital. For 4 years I was told she had adopted her privately. I just received a summons for a child support hearing and they're pursuing child support, accidental and medical coverage for the child.

Going through child support enforcement rather than a private attorney to obtain child support often takes a lot longer. Only the person assigned to your case will be able to tell you how long it will take, but it could be 6 months or longer.

Yes. You can add to a parenting plan that neither parent disparages the other before or to the child. This is common language in a parenting plan, but without the language this should not be happening.
