You can't make him exercise parenting time. You can file a contempt action to recover the child support.

Q: my boyfriend is currently incarcerated and got served with child support papers, he doesn’t know what to do.

he wants to wait till he’s released to deal with the issue and wants to know if the judge will let him.

Q: If the person you are filing child support on works for tips and is only making 2.13 an hour, hows it calculated?

The father is a server and on paper only makes 2.13 an hour on his check. I know he doesn't claim all of his tips. How will a judge make a fair decision on the order when he is not claiming all the money he actually makes?

the judge can make a reasonable inference or guess as to actual income. You can also subpeona bank statements.

Q: if a child have a mental disorder what will be the cut off for child support?

My child is 18 and recently diagnosed for a mental condition. He is beginning 12th grade this year.

Your child support order should state the cutoff. Normally, child support will continue past age 18 if the child is in high school, but in no event longer than age 20.

You should file for divorce and get a court order on custody. Your husband doesn't have to return him as he has as much legal right to your son as his father does. That can only be modified with a court order.

Q: Can the cp ask for another hearing on a default order that is wrong. Ncp was a no show And cp has no info on ncp income

Ncp was ordered to pay 381.00 a month for 2 children but is a millionaire from an estate trust settlement. He did not provide any income info nor did he show up to court hearing. It’ was a default order. What can I do to fix this default order that is incorrect

Yes if arrears is owed, it doesn't expire just because the child turns 18.

No necessarily. Single parents are granted custody all the time. The court takes into consideration a variety of factors.

Yes, she can put you on child support. You are supposed to pay child support, no matter where you live. Hire an attorney to discuss your options, but you should start paying voluntarily immediately. Failure to pay child support is a crime.

Child support is going to take awhile when you go through child support services. A private attorney can unusually get an order much quicker, but there is a cost to their service and child support services is free.

Q: can a visitation/child support contract be modified right after signing it. and can the mother get back support.

both parents just signed a court ordered visitation and child support agreement and child support was being paid before agreement was made. mother is now mad and threatening to go to child support recovery for the child can she?

The question is not answerable as written. I am not sure what you mean by child support contract. I can't tell if there is a court order, or just an agreement. You need to talk to an attorney about your situation and they can review your documents and give you advice.

Yes, however, the father will need to file the petition for legitimation in Superior Court and have the mother served with it. The Court in the legitimation action can establish custody and visitation rights of the father.
