The government issues citations, not private citizens. There is no such thing as a private "ticket."

Call someone directly. Most criminal defense attorneys provide free consultations, but there is no information even provided in the question to be able to provide any answers that would be helpful.

Q: Pulled over for speeding. Written a ticket for no insurance. Showed him my insurance. Told to send it in and fight it.

The officer took my ID and returned to his car while I looked up my insurance info. He returned with a ticket for speeding and no proof of insurance. I showed him proof of insurance. He said he couldn't remove the ticket because it would be more work and I needed to send the proof in.... View More

No, it does not de-legitimize the speeding ticket. The two issues are completely unrelated. There may be a legal issue with the speeding ticket, but this is not that issue.

The charge is a misdemeanor because there was property damage involved. You will need to appear in court for this and you should strongly consider getting an attorney - either a private attorney or a public defender if you cannot afford one. You are unlikely to lose your license, particularly if... View More

Q: In minnesota does the state have any law or statute regarding crossing the fog line Or local ordances?

In the last 6 months i have heard of a few people that this was given as the primary reason they were being stopped. A good reason to do a quick look or sniff. Thank you for your time.

Consider a Driving While Impaired Case. It would begin with a police officer's traffic stop of a driver. The police officer would need reasonable articulable suspicion of a crime, or an observed violation of a traffic law. Either-or both. In the case of crossing the fog line, i have had... View More

This question gets asked all the time. An error like that is not automatically going to result in dismissal of the ticket. Those errors can be amended by the prosecutor. There might be other issues that could benefit from a conversation with a defense attorney.

You can always contest the ticket. The officer isn’t required to show you the radar or inquire about registration. Your best shot to contest the ticket will be with the assistance of an attorney.

Q: I received a citation for speeding 74 in a 55.

When the officer pulled me over, he asked me how fast I was going and I admitted to 70 and he said 74. No. That is not a basis for dismissal. As art of the discovery process, you can get a copy of the citation and the police reports. There may a basis for a challenge, but a different officer’s name isn’t going to be the basis for challenge.

Q: I got pulled over for a "stop sign violation" and I looked at my ticket and he put down the wrong year, make and model

Of my vehicle. Would I still have to pay the fine?

Thomas C Gallagher

The police officer writing the wrong year, make and model of the vehicle on a speeding ticket would not automatically make the speeding ticket void. Not paying the ticket and not contesting it in court, would result in the listed driver being convicted. The state could then pursue collection... View More

The issue is not the residency. The issue is whether the ticket is charged as a misdemeanor or a petty misdemeanor. A petty misdemeanor does not carry the possibility of jail time and consequently you would not be entitled to court appointed counsel. But you would if the charge is filed as a... View More

The police need reasonable articulable suspicion to pull someone over. There isn’t necessarily anything illegal about what you did, but other factors might’ve played a part in why you were pulled over. Speak with attorney directly about your situation for more specific answers about your situation.

Q: Speeding ticket for 70 in a 60 in MN. Clean record for previous 5.5 years. Can I get a continuance for dismissal?

I haven’t had a speeding ticket in 5.5 years. I don’t mind paying the fine, I would like to avoid the insurance hike. Is it possible to get a continuance for dismissal based on my driving record or will previous tickets remove that option altogether? Ticket was issued in Steele County, MN.

The bigger issue for you is the county where the citation was issued. Not all counties give continuances for dismissal during the negotiation process. They are far harder to come by the further from the metro that you get. Steele County may not offer continuances for dismissal as a matter of... View More

Get representation. Fighting it yourself is unlikely to be successful. Generally speaking there is not any compensation available even if you are successful challenging the citation.

Yes, of course, every speeding ticket can be contested, and should be. Focus on the desired outcome. Perhaps that can be met by agreement. Next, gather all facts and keep an open mind to all possible legal defenses. That defense may be the best available, or another might be better. If it's... View More

Have time a curfew at the house and didn't want to arrive home late, so I had to rush to get home fast and, my mom was sick, so I had to take care of her in all ways, so I had to sacrifice myself for hers.

i was trying to know if I can go on probation for the ticket I've received

There isn't really a question here. Were you charged with speeding? Have you already paid the fine and consequently plead guilty to the speeding ticket? You need to more clear on what you are asking for anyone to help you.
