Q: Does the Dimler rule apply for 54 in a 45, or not because it was not a 55 or a 65 speed limit zone?

My son received a 54 in a 45 speeding ticket. The office said it would not impact insurance since it was only 9 over. In reading the statutes, this seems fuzzy when it’s in this speed limit zone.

Unlikely. Courts are generally extending the 30 day deadline due to covid. A lawyer can give you more assistance as it is clear you are unfamiliar with how this works.

Q: Why is my appearance in court mandatory?

I was in an accident due to a failure to yield left and they found me at fault for the accident. If the officer checks the "property damage or injury" box on the citation, the court appearance becomes mandatory. That means failure to appear will result in an arrest warrant. A misdemeanor is a crime punishable by a maximum of 90 days jail, though jail is rare in cases like this.... View More

Paying the fine is a guilty plea and it will go on your record. It will also likely affect your insurance rates. You should consider challenging the ticket. An attorney can help make success more likely.

Q: 30 day deadline is today for citation. Would it be wise to wait until Monday to call them and talk to a hearing officer?

30 day deadline

Pay citation and hope for the best

Or contact them on Monday

Paying the fine is the equivalent of a guilty plea. I would contact the court tomorrow and set something up with a hearing officer. The court won’t do anything with the citation today because it’s Sunday.

Q: My son received a ticket on 8/16 in Isanti County. The ticket is still not found today 9/18 in the system.

It was for speeding and he didn’t have proof of insurance. I have looked it up online and called the number on the ticket. How long do they have to submit this information?

William Bailey

The general statute of limitations is quite long. I’ve seen it take much longer than this for a ticket to get uploaded as officers are not always the most reliable. A lawyer could look into this with the police and courts and find out what is happening.
