Evictions procedures are governed by NJ statutes. The process must be strictly adhered to by the Landlord. I don't understand the point of the question. While my colleague Mr. Gelb is correct, you can't make the landlord promise not to evict you, assuming that you are covered under New Jersey's anti-eviction act, you can't be evicted unless you violate 1 of 17 different restrictions.... View More

Check with the municipality if there is some rent control or stabilization program in effect. Also call your county's legal aid office for assistance. Otherwise the Landlord can charge whatever is deemed to be in the Landlord's best economic interest.

Q: Landlord not returning security deposit because they didn’t receiver letter that I was no renewing

Moved out end of September. I sent them letter via Mail that I was not renewing in august. They said they never got letter when I called early September. Now over a month later they are not giving it back because they didn’t get enough notice

You may file suit in Special Civil Part for return of the security deposit. If you win, you will be awarded an amount double the security deposit. If you retain an attorney and win, the landlord will be required to pay your legal fees.

Q: Can tenant I am evicting testify against me in another civil suit regarding previous tenant in nj

Eviction is non-payment of rent. Civil suit is property damage and non payment of last month of rent. Both were forced to leave under bad conditions are very disgruntled. Eviction is scheduled for April 2 and civil trial with previous tenant is April 5.

The tenant you are evicting can testify. You can ask him about his eviction for impeachment purposes, to show bias against you.

Q: Hi, Need help with writing addendum to the existing lease agreement.

Every NJ lease whether oral or written is deemed to have a provision of quiet enjoyment. Except for emergency reasons such as leaking water or gas, no one can enter your apartment without your consent.

The landlord's right to change terms in the lease can only be done if the lease provides that the landlord may make such changes and specifies the method of notice.

The landlord has the ultimate right as to the terms of a lease. If the tenant rejects the offer, the tenant must vacate on the termination date in the current lease.

Anyone can file suit. IIf without merit, the Court can impose sanctions on the person who filed the complaint. The real question is whether or not the person can win!

Yes, if it provided for in the lease. If there is no provision for payment of legal fees and court costs, the Court may not award same to the landlord.
