Possibly, but understand a bad result isn't necessarily malpractice--you have to show the doctors fell below the standard of care for their specialty in how they handled it and that caused the failures. But it's an indicator, so contact a member of the Pa. Assn for Justice--we all give... View More

Q: I had a surgery done to my knee at a outpatient surgery center. The surgery went well. However, within hours of coming

Home I started to bleed and rushed to the emergency room where it was determined that I had an arterial bleed. The doctors at the hospital said I should not have been sent home with that. They said someone should have seen it and fixed it before discharge. Is this malpractice or neglect?

Sounds like it. Fortunately you got to someone in time so this may be one of the thousands of "freebies" the medical profession gets each year--cases where the carelessness is caught in time before lasting harm happens, so the case is not worth the $30,000 or more it costs to handle a... View More

I'm sorry to hear about your terrible experience. First, jot down who says what and what happens. You have some time so first thing is to get your child on the path to recovery. Do not mention to anyone that you are thinking of suing --many doctors will be shy of treating your child if they... View More

Unsure exactly what happened. If you went to trial, the other firm would have spent money and only be paid if they got you money so they have an interest to try the case. Understand that proving that the doctor did something wrong and it was that that caused your problems is difficult. In your... View More

I'm not clear that you have received treatment. If not seems something about your condition is holding doctors back. A problem is I'm not hearing that a doctor says use medication ______, it's used, and seems to have some effect. Second problem is that there is a statute of... View More

Abandonment is sketchy but not illegal, and your energies are better spent finding another doctor. If he is part of a large medical grouping--Geisinger, UPMC, Reading Hospital etc--call their patient care coordinator and explain your confusion and ask if they can give you a referral.

If not lawyer wants to take on your claim it is because they do not see any money in it. In other words, the potential value of the case is too low for their involvement. That's what's going on.

2 years from the date of the alleged malpractice. There is a discover rule though which may extend this to the time of discovery. Examples may be having surgery and the doctor leaves a sponge or medical instrument inside you - in such case you would have no reason to know until some other event... View More
