Unless it's for allowing an unlicensed person to drive then no that's not right. Hire a lawyer to get it dismissed.

Q: Will I get in further trouble for updating my license(out of state after moving) after receiving a ticket in Va?

If I go to the DMV and update my license, will I receive further penalty due to my current speeding ticket having my address down as from another state? I have lived in VA past 60 days without updating, but it has not yet expired.

You most certainly have a duty to update your license. There are limited exceptions for military/students but the law generally is you must update it within 60 days of moving here. Hire a lawyer to get the case in Virginia reduced or dismissed. That will help with points. But definitely fix the... View More

Yes. You have 10 days from the date of your conviction to appeal your case to the Circuit Court. You can hire an attorney to represent you on that new court date.

If you have an attorney already, it would be best to schedule an appointment to discuss your concerns in person with them.

It is smart to do the driving school. At that speed, if you were to hire a local attorney, you would not need to appear in court (the attorney could go on your behalf). The ticket will not impact your record until after court.

When you initially get a license you have a 0 point balance. You get positive points for every year you have a license. Your +3 could be because you haven't had a license long enough to get 5 positive points.

If you took a driving class for a dismissal less than 5 years ago, many judges will not give you the option again. Speak with a traffic attorney in your specific jurisdiction to see if there is any extra info you can give that might help your chances of a reduction or dismissal.

Sounds like the officer may have accidentally filled in the wrong code section. As you likely noticed, 46.2-835 references turning right on a red light. I live in Virginia and am buying a car from a state that did not require front license plates. There are no brackets or holes to mount a plate. Do I need to "alter" the car to accommodate a front plate or is their a provision for this situation?

The ticket was issued in Norfolk, VA and when I log into the website to pay the ticket I do not see the ticket. Am I off scotch free or what? If I am not off scotch free then why is it not in the system and how do I pay it?

Q: I was issued a summons for failure to obey highway sign, I was going 49 in a 35, and I am wondering if I should prepay.

I don’t feel like I was going 49 since I was driving with my cruise control at 40. I don’t know if I should just prepay this and take the hit or go through with the summons the officer gave me.

Yes, court dates can be adjusted to allow time for you to save up to afford a lawyer. Depending on the county, jail time or suspended jail time may be a possibility. Most judges I know wouldn't dismiss for writing roman numerals vs. the actual number. The judge allowed it and I don't see that you have any remedy beyond appeal which may or may not be a good idea.
