You should get advice for counsel in your area. Perhaps they can help you obtain any traffic cam from in that area in order to prove your innocence if the officer is mistaken.

Q: If I got reckless not a DUI but I wasn't coherent and think I got drugged should I use that in court?

I'm in VA and was at a party the night before the accident and I dont really remember any of it up to the point of the charge. They did sobriety tests on me and it wasn't because of alcohol. I'm pretty sure someone roofied me.

Whether or not you were under the influence of an un-administered intoxicant will be up to you to show to the court and what evidence you can show of that fact - not just your assumption or speculation. Q: Got first DWI in VA on felony probation. was told id be violated. been 3 months and nothing. do i have to be convicted?

You do not have to be convicted but sometimes this is the way that the probation officer will do it as long as you have let them know about the arrest. You are technically not in violation until you are convicted if the arrest is reported to probation as well.

You can't leave. However don't make any statements to the police as they may have identification issues etc if the passenger ran and they aren't able to identify you.

More than likely you will need to bring in your registration of your vehicle to show the vehicle is properly registered. You more than likely have been charged with Reckless Driving which is a class one misdemeanor that can end up with jail time of up to a year. 80 miles per hour is reckless driving not speeding. Q: I lived in MD some ten years ago and has MD driving license. I have lived in another country since then.

And recently got a ticket for failure to update Licence while I had a short stay with family in VA. I was just in US for less than 3 weeks .

You are required to update your license within 60 days of moving to Virginia. If you plan on remaining in Virginia you should obtain a Virginia license. If not, then you should get an updated license from your new state of residence.

Q: If the attorney don't show up on a court date for a reckless driving in VA, who will be at fault ?

I may or may not be able to appear on the court date and have retained an attorney. But want to know the consequences of the attorney does not show up on the court date for any reason.

Your lawyer should advise you if you need to appear in court or not. Since courts require your presence even with a lawyer. Get it in writing from your lawyer on whether you need to appear or not.

Q: Is it possible to get my speeding ticket dismissed due to missing information?

I recieved a speeding ticket today for doing 76 in a 60. Officer left case number blank and made me sign the white copy after he already ripped the carbon copy off and gave it to me; so neither copy had a case number and my copy doesnt have a signature. Is this cause for dismissal?

Every court is different at that speed. Talk to a traffic lawyer in the location you got the ticket. Q: What will happen on my second speeding ticket as a minor?

I got a speeding ticket 5 months ago and the judge said if I didn't get another one, did a driving class, and did community service, the charges would be dropped. I just got another ticket before the 6 months are up.

Unfortunately, since the judge cut you a break, its likely you will be found guilty on the original ticket and perhaps the new one. 101 mph is not a speeding ticket, it is a criminal misdemeanor. And yes, most courts both require your presence in court and give some jail time for driving at such a high rate of speed. It depends on your age and prior driving record. If you're licensed in Virginia and 20 or older it doesn't sound like it would get suspended. The court can suspend if it's reckless driving by speed though.
