Q: If you are turning from a public road to a private one who has the right of way??

At any intersection, the same rules under WV law apply. Your question did not indicate if the person turning was turning left or right. However, if turning left, that motorist must yield to oncoming traffic before executing the turn.

Q: In WV is it legal to drive over a sidewalk with a yellow line to park in a parking place?

Probably not, but it is difficult to say because I don't have enough information. Did the driver drive clear across the sidewalk to reach an empty parking space in a parking lot? Or did the driver inadvertently drive one tire over the edge of a curb while parallel parking? Without more facts, I can't give you a more definitive answer.

You should contact an attorney in the county in WV where this accident occurred to discuss representation for your father. Due to his CDL privileges, it is important that the offense does not end up on his record. An attorney may be able to fight the ticket or attempt to have it amended to a non-moving violation. Ideally, the attorney would appear your father's behalf. However, only a local attorney is going to be able to discuss specific options. Best of luck!
