Speeding 26-34 mph over the limit is a Class B misdemeanor. Technically, it is punishable by a maximum of 6 months in jail and a $1,500.00 fine. However, assuming that this is your first offense and you were polite and cooperative with the officer, it may be possible to keep this off of your public... View More

Speeding 26+ mph over the limit is a Class B misdemeanor. If you are convicted of 2 moving violations within a 2 year period under the age of 21 you face a license suspension. It may be possible to avoid a conviction depending on a few factors. An attorney can certainly assist you and ensure the... View More

Q: Ticket while using a cellphone. No option to pay without admitting guilt.

I thought that there is usually an option to pay the fine and not have it affect my driving record or plead guilty. Only option appears to be paying the fine and pleading guilty or requesting a trial. The trial location would be hours from my home. Am I missing something?

It is possible to keep it off your record but you may need to have an attorney appear on your behalf if you are unable to attend court. Not all tickets have the option of requesting supervision without a court appearance.

Because the offense was for speeding 33 over, this is a Class B misdemeanor. Technically, you are facing a maximum penalty of 6 months in jail and a fine of up to $1500. However, there are many possibilities based on a variety of factors including your driving record. Contact an attorney directly... View More

Q: I was pulled over for going 93 in a 70 in Wisconsin, but live in Illinois. How will points work?

I have a clean record as this is my first offense. Is there a way to either reduce points or get the violation removed through supervision and/or traffic school? I’m 21.

Wisconsin does not have court supervision. Ideally the ticket would be reduced to a non moving violation. An attorney in Wisconsin may be able to assist you or advise whether that is possible. Paying it outright would result in a conviction on your Illinois record.

A motion would need to be filed with the clerk of court to reopen the case. It is still very possible to obtain court supervision. An attorney may be able to handle this process on your behalf without the need for you to to appear in court.

Q: I live in Illinois and I got a speeding ticket. Do I have to go to court in person to request court supervision?

I want to request court supervision, but going into court is a problem right now because of the Covid-19 pandemic. I live with several at-risk family members. Can I request court supervision by mail?

That depends on the type of speeding ticket and the courthouse where it is assigned. If your ticket is not marked as “must appear” or required court appearance, you should have been given instructions along with your ticket. The instructions may be an envelope or on the back of your ticket. If... View More

Q: Im 19 and first offense, I got a ticket for going 91 in a 50. What does, “Method of release: promise to comply.”, mean?

Also, is there any way to go about this without insurance finding out, and/or without it staying on my record? Finally, what would this be classified as? Again, first offense but I am young so they may slam me... thank you.

Promise to comply is your agreement to appear in court. You could have been required to post a cash bond instead. The offense itself is a class b misdemeanor, technically punishable by up to 6 months in jail and a $1500 fine. However, it is certainly possible to minimize these consequences and even... View More

Q: I was told that I would receive citation for speeding in the mail in 2-4 weeks, I have not seen it. What should I do?

I receive a ticket in Mo. The officer told me that I should be getting the citation is 2-4 weeks. I looked up my name in the case.net. I could not find my name in the system. I guess I wanted to take care of the ticket, before I get a warrant out in my name.

I would also suggest contacting an attorney in MO (ideally someone in the county where the ticket was issued) or the clerk’s office in that county to see if they can shed any light on the current procedures and any delays.

If you were arrested at the time of the offense or if you were placed on bond, there would still be an arrest record. An immigration attorney would... View More

A third conviction within 12 months will suspend your driver’s license. If you are eligible and have the option to take traffic school without appearing in court, that is a form of court supervision, which will not count as a conviction. As a result, it will prevent your license from being... View More

If you already missed the deadline for both, you (or your attorney) would likely need to file a motion with the Clerk's Office for each case in order to appear in court before the Judge and request that the sentences of court supervision be reinstated.

You can technically receive court supervision on up to 2 traffic violations issued within any 12 month period. The second order of court supervision would typically require an in-person court appearance.

Q: Can I still apply for court supervision even if I don't technically qualify?

I was driving 25 mph over the speed limit, but I was going below 90. Normally, I know that you can qualify for court supervision if you're going 25 or below, but in the county I was pulled over in it is 20 mph and below. Could I still apply? I'm 17 and this is my first speeding ticket.

Because of your age (under 18), you would need to appear in court with a parent or legal guardian to request court supervision. An attorney can certainly assist.
