Yes, you should inform the USCIS about it. In order to show the good-faith nature of the marriage and, if applicable, the divorce proceedings (including court proceedings or settlement contracts), you may need to include this information in the package when requesting USCIS to proceed with your... My response would be NO. The H-1B visa demands non-immigrant intentions, indicating an intention to return to your home country after the period spent working. Filing for asylum, or being a derivative of an asylum application with a request to never return to your home country, conflicts with this... View More

For my NIW application, part of my evidence was a paper I was working on that was submitted for publishing in an academic journal. However, the paper did not get accepted. If my I140 petition is approved, will this be a problem for adjustment of status?

Not necessarily. I-140 is normally based on what you provided before it is approved. I-485 should not be a problem unless the I-140 is based on frivolous evidence.

If the asylum application is not filed, your cousin should immediately check if they qualify for it. Furthermore, always find a lawyer who is experienced with asylum cases, especially in immigration courts, and has an understanding of the asylum cases from your country.

Regularly check the EOIR online case status using your A Number. If your case has been forwarded and is now on the docket of your immigration court, the system will display the next step. Avoid relying solely on mail.
