You need to file and get an order in place and work on not allowing the kids to live there. If his name is on birth certificate and there are no orders, then he has rights to take them unless you get an order. 888-343-4529.

It would not be automatic. It would depend on the best interests of the child and the court’s interpretation of that standard. Good luck.

You could get in trouble if there is an order that says that you can not have possession.

Q: My brother just died. He was divorced for many years and had two children with his ex-wife but gave up parental rights.

So her new husband could adopt them. Do the children have a right to his property and get to decide how and where he will be buried? Also our mother and father are deceased. As the oldest sibling do I have the right to make these decisions. My brother had no will.

Unless the adoption order specifically indicated that the children do not take, then they have rightful claims as heirs. Also, there may not even be a formal order of termination. You could do an affidavit of indigency indicating that you can not afford the filing fees. But, I would suggest you contact the State Bar of Texas for low cost options.

If the beneficiary designation was done before the marriage the designation may be called into question. You only set out as to when the policy was issued not when the designation was last changed. Good luck. 888-343-4529.

The first thing that I would want to know what your practical goals and reasons for wanting to modify the prior order. Sometimes it’s not worth paying attorney fees if you can continue living your life as you’ve done for the past couple of years. Good luck.

This is ridiculous. Your child should not be getting harassed by her father about child support. He has no right to get the child support back. Ask him in writing to stop doing this. Good luck.

If your misdemeanor case has not been resolved give the info to your attorney. If it’s over and you plead guilty you’re probably out of luck. Consult with a criminal appeal lawyer for possible remedies.

The answer to that question depends on a lot that you question does not provide. But, in general you can have an uncontested agreed upon divorce granted in 60 days from the filing.
