Q: If I live in Georgia and the father lives in florida, would I be able to file for child support even though I'm married?

He states that if I do file he wouldn't pay it and says since he is in florida they will protect him if he doesn't pay his child support? That he just can't enter back into Georgia. I'm just wondering if this is true or not?

You can file for child support in the state where the child resides and it will be enforceable in any state of the US.

It is definitely recommended that you have an attorney when attempting to modify custody. The court does not have to accept the 14 year old's election if there is a showing that it is not in the child's best interest.

I agree with my colleague. You will need to meet several technical requirements in order to register a foreign judgment and custody modifications are complicated in general. The combination of both I would not recommend handling without legal counsel. You will only get one bite at the apple and... View More

Q: My sister owes child support arrears in Georgia, my nephew died in February. Do the arrears go away?

My Sister was owed child support.

Then custody changed. Now she owes arrears. My nephew died in February at the age of 21. They are still taking her taxes and stimulus. Is this legal? It seems as though the arrears would be deleted after the death of the child. Can this be changed?

You can contact the judge's staff attorney to see if any additional information is needed. You may need to file a Motion for Judgment on the Pleadings if that has not already been filed to obtain your divorce decree.

There could be a number of reasons you are still paying child support. The adoption may not have terminated your parental rights or you may have had arrearages that you are still obligated for. You should consult with an attorney to review the specific circumstances of your case.

You are not require to provide housing to an adult, but if he refuses to leave willingly, you will need to evict him. You can not simply lock him out if he resides there.

Q: Are registered sex offenders allowed to have social media and use it to talk to minors?

I know a registered sex offender that has social media and uses it to take screenshots of accounts and to chat to minors. He follows probably hundreds of minor accounts and talks to at least a handful. I know he also has nudes from multiple minors in his phone or google cloud

If there is no custody order in place, he has no legal right to visitation. However, if there is no concern of danger with dad, I would not use the pandemic to now cut off visitation that he has historically been exercising. If you do so, he will likely be motivated to now file a legitimation... View More
