I need a domestic violence prosecuter not domestic lawyer
answered on Feb 28, 2022
For domestic violence complaint purposes, It is not uncommon for the person filing the domestic violence complaint to have a lawyer represent her in connection with the preparation of the complaint and to represent her in connection with the trial. Our office handles that type of setting on a... View More
We have shared custody but she lives with me. I also have health issues and the weather will be helpful for me.

You need to have a consultation with a family law specialist since the law changed several years ago, making it tougher for the primary custodial parent to relocate elsewhere with a child when the other parent objects. There are a number of questions that the lawyer will need to discuss with you... View More
My father lives in New Jersey. I am my dads only son, I checked online and he owns 3 properties and they are under his and her name, I fear that she will give it all to her kids
answered on Feb 28, 2022
My suggestion is that you schedule a consultation with an estate law specialist (not simply a general practice lawyer who also handles estate work) to find out your rights.
Presuming your father passed away without a will and presuming that title to the 3 properties were in joint name with... View More

Florida, like New Jersey, requires someone to be a resident of its state for at least 1 year for jurisdictional purposes - meaning the ability to file a complaint for divorce in that state.
So, if your stepdaughter has been living in Florida for more than 1 year, she can file a complaint... View More
Hi. I am tutoring a 16 year old. His mother asked if I drop him home from the library. Can she sue me for life if I get into an accident, how can I avoid this situation? I'm worried. Can I have her sign a contract or is verbal/text consent okay? I am a 20+ adult.
answered on Feb 28, 2022
The short answer is that if you are so nervous about driving someone home from a tutoring session, then politely tell the parent that you are not comfortable driving their child because of potential liability issues, in the event you get into an accident with their child in your car. The parent may... View More
I just recently found my biological father through ancestry.com. what do you think I should do next? I already tried to reach out to the family and they said that he died already. Donald Trump said that anybody who found their dads during his presidency he would get at least $100,000 for. I saw it... View More

Is this about getting the 100,000 or really trying to locate and connect with your biological parent?
If it's about getting a 100,000 payment, I don't think that it will occur. I have never heard anyone suggest that our government was/is planning to pay money to anyone who is... View More

The first question is what does the power of attorney form cover? Is it a power to handle your mother's financial affairs or is it a Do Not Resuscitate power if she is hospitalized or both? A power of attorney is not the same as a will and does not give your brother a greater right to her... View More

I agree with Mr Aalsberg, that the best way to start the process is for your father and you to meet with NJ estate planning counsel to draft the various estate planning documents, starting with a living will (to address the handling of medical decisions if he becomes incapacitated), power of... The fact that the court denied your ex's application 2 years ago does not give me enough information for me to answer the question.
Did the court deny his application 2 years because he failed to follow specific procedures set forth in the divorce agreement or did the court review the... View More
Attorney rarely responds to emails, cancels most scheduled calls, she's not responding to opposing counsels emails or calls. At what point can I file a complaint to the NJ Bar?

As a general statement, most lawyers send out statements monthly or every other month. I dont know if you retained a lawyer on a flat fee basis or if you paid a retainer with the lawyer working against the retainer, but the easiest way to find out the status of your setting with counsel is to call... You need to schedule a post-divorce consultation with a divorce law specialist to review the terms of your divorce agreement and your current setting to see if there is a proper basis for reexamination/modification/enforcement of the terms of your agreement. Most divorce lawyers will schedule an... View More

I have a feeling that you are mixing up terms. Generally speaking, under the healthcare section of your divorce agreement, presumably, it states that as the primary custodial parent, you are responsible for the first 250.00 per year per child of their unreimbursed healthcare costs (a requirement... No. Without being disrespectful to you, it appears that you are failing at representing yourself and then being angry at the results. Can she claim his house if he didn't take out a policy, required by divorce decree?
answered on Feb 1, 2022
The reason why a divorce agreement or court order would require someone to take out or maintain a life insurance policy (generally) is to secure a financial obligation owed to the other party. The common example would be if he had an alimony obligation to you, then during the period of time that he... View More
Showing domestic violence as evidence in court? Does the person have to consent to being recorded? Or just be aware of the camera? Do they have to know it’s recording and saving?
answered on Jan 31, 2022
My suggestion is that you meet with a divorce law attorney to help educate yourself on how to present evidence at a domestic violence trial. Giving you a simple yes or no answer will not help you unless you know how and under what circumstance a court will permit it to be used.
I have no Idea where she went nor do I care to know. How do I go about getting a divorce from this person?

1. You can file a complaint for divorce immediately.
2. After you get the filed complaint back from the court (with the docket number), you need to undertake a good faith effort to locate your spouse and arrange for a process server to serve the complaint for divorce upon her.
