Q: I want to sue a school district for defamation, but I can't find a lawyer who deals in educational civil litigation.
Management fabricated a story, an easily disprovable story, because, in the story they made up about me, they also made up witnesses to the made-up story. This is a discrimination case as well as a defamation case. I am being harassed because of my color. I need to find a good lawyer who will take my case, but I can't even get to the point where I explain what is going on in my case because I can't find a lawyer who sues school districts. I was told by a lawyer to contact the California Bar Association. I was put in touch with a Fresno County pro bono service that referred me to AVVO.com. It feels like I'm going in circles.
A:
There are many attorneys who sue school districts, but less attorneys who take on cases for defamation. These type of cases have many risks and complications. Additionally, not all cases where it is believed there is defamation and or harassment, actually fit the what is legally considered defamation or harassment. If you are willing and able to hire an attorney on an hourly bases (not a contingent/percentage fee), and willing to take the risks to yourself in bringing such a case (being responsible for the other sides attorney fees and costs), you may be able to more easily find an attorney.
As with any case where the person has difficulty to find an attorney, the person must continue contacting attorneys who may take the case. It happens that a case can be rejected by many attorneys, but be accepted by one.
A:
If you have not found any attorney who are willing to sue school districts, you have not been looking closely enough. There are literally dozens, if not hundreds of attorneys who sue school districts all the time.
Your issue may be that the attorneys do not see your case as having sufficient merit or value to offer their services on a contingency fee basis. You are going to have to keep looking. And if enough attorneys turn you down, you may have to reconsider your intention to sue.
Good luck to you.
A: If you're seeking a defamation attorney on a contingency basis, that could be difficult to find in many cases. Such cases can consume considerable resources, and the outcome is not always clear. And pursuing a defamation matter on a billable hour basis can be a risky and open-ended venture. Good luck
