If you didn't know you hit something, chances are you weren't paying attention and were at fault or partially at fault. But, more information is needed to know for sure. Talk to a GA lawyer about your specific situation.

Q: i had an accident in March and Gap claim filed but to no avail. How can i approach?

My vehicle was totaled on a trip to South Carolina to the fault of the other party. My auto insurance has processed and paid on my claim with the balance filed with Gap. i have been getting the run around.

Q: Consortium. Is it a valid claim & can I file for it?

fiancé has been asked to settle. I was unaware I had any rights to this matter at all. They are requesting that I sign it also and I am not comfortable signing it.

Unless the laws are very different in your state, a loss of consortium claim can only be made by a spouse, not a fiance. Why would you be asked to sign the release? What is her lawyer telling you?

If you have not incurred any injuries, it is unlikely that an attorney would accept your case. No injury equals no case. If your car was damaged, turn it over to your insurance company.

if you are hit by a car or truck, you can sue either in the state where the accident happened or where the defendant resides. you also may have jurisdiction in federal court if the plaintiff and the defendant are from different states.

Depending how the court handled the charges, it could add points to your record. It is unlikely to result in the loss of your license unless you have a substanital number of points already or something else occurred during the accident.
