Q: Child support gets taken out of my full-time job check. I'm getting a second job. How do I get child support taken out?

I'm getting a second job - a part-time job - in addition to my full-time job. How do I get child support taken out of my new part-time job? Do I have to go back to court? Thank you!

As long as the full amount of your child support is taken out of your one job, there is no need for it to be taken out of any other jobs you have.

The income of one's new spouse or live-in significant other cannot be used when determining child support obligations.

Q: I have received a notice of intent to pursue collection remmedies from the custodial parent. What are my next steps?

If I file a modification will that stop the state from pursuing this debt that I owe? Or at least stop them from suspending my license,credit reporting , and etc?

Modification is for future changes.

If you are in violation, you will have to address that as a separate issue.

If there really is a need for modification the other side may be willing to work out a deal.

She can file a paternity case and have a summons served on him.

Nothing will happen until the child is born.

This allows the court to have jurisdiction over the father in case he decides to skip.

No, nothing can be taken out of your check. Child support is based upon his income and her income for the children that they have. Your children will also be taken into consideration.

Q: Our court case started in 2012, keeps going for status, he has never lived with his dad since birth in 2007.

There has never been an order for support, and we were never married. My son doesn't see his father at all because of other charges on his father. Can I get child support up to the initial case start in 2012 and how do I get this finalized?

Child support is based on income of the parties and how much time the child spends where.

Child support normally starts when a court case is filed.

Q: I owe $70,000 in back child support from a hookup I had 35 years ago and now shes taking me to court. What should I do?

After the kid was born, she moved out of state and did not contact me again besides taking me to court for child support. I have never paid but I do not have a job or any money saved up. I have not filed taxes for a long time and don't know what to do. Is there any way I can get this case dismissed?

If you don't have income, you are not eligible for Chapter 13.

They are probably getting things lined up to start taking it out of your social security checks.

Q: How long will a sheriff try to serve an order for child support in the state of IL? And what happens if no service?

The states attorney has told me that the sheriff has attempted to serve him 4 times in the past 4 months but he is never there. She also mentioned that if this goes on long enough my case may be dismissed? Is this true?

Who ever has a child has the right to get support from the parents unless the child was adopted out.

Fortunately for you, she can only go back to the time she filed the petition for support.

The child support will not automatically stop. You have to seek a court order terminating the child support. If his support is coming out his check, a notice terminating the child support withholding needs to go to his employer after the court terminates the support.

If there is a sufficient reason, such as reduction in income, child support can be adjusted.

The amount of arearage cannot be changed unless by consent of parties.

Child support is based on a formula that uses the parents' income.

The court can deviate from the formula if there are special reasons.
