Q: My ex quit his job after he had an income withholding order. Do the courts keep track of how far behind he is?

He was current until the end of December, then he changed jobs. He completely stopped paying and has only had one visitation since Thanksgiving. He’s over $3,300 behind.

Based on the information you provided in this question child support does not stop until 19 or if the child attends college or can convert to college expenses. If you are that far ahead you need to contact your local Child Support Office and discuss your options with them.

Q: My sons girlfriend moved everything out and left with both kids. Without telling him where they were staying.

She then told him that the place she moved into was not fit to live in. So she told him if he moves out of his apartment and pays for the rent he will at least know where his kids are. If he does not have a custody order in place he should definitely seek one out immediately. That it the only thing that would give him enforceable parenting time with the children. Without that, there is little to stop the mother from leaving again with the children.

There are only two requirements for anyone to receive the stimulus check: Filing an income tax return for 2018 or 2019 (2019 tax returns can be filed anytime, but--because of the pandemic--they are not due until August of September, 2020); and still be alive and breathing.

For IRS purposes whichever parent provided more than half of the support for the child is the custodial parent and is entitled to claim the child.

To transfer that right to the other parent requires a Form 8332. A verbal promise is not enforceable.

In Indiana both parents are to have equal standing before a court when it is making determinations on child custody. The primary determining factor for custody decisions is what is in the best interests of the child.
