Q: In Louisiana, can child support inforcement go after my VA disability check? I am totally disabled and am unemployable.

My Disability check is my only income.

Q: How long does it take the state to process a 15k child support payment that is clearing up all arrears?

Arrears are cleared but I've not gotten a payment in the large arrears amount. Would there be a reason arrears were forgiven without my consent as domicile parent?

Child support arrears are only collectable back 10 years.

1) You won't get overpayment back.

Q: In Louisiana if you only owe back child support, can they go after your spouse now, for anything? They take my taxes.

They also have my license suspended can I get my license back before the child support is paid out?

If you file joint tax return, they can take entire refund as community asset to pay separate obligation. Cant get your license back until you satisfy child support arrears.

You need to hire a child support attorney in TX. I suspect something has occurred without your knowledge.

Both parties have to agree to dismiss a motion. However, you can ask the state to dismiss, if you were using support enforcement.

Q: Non-Custodial Parent is moving before the court hearing

What happens if the non-custodial parent moves before the court hearing ? Right now we both live in Louisiana but he is about to move to Texas and we have our first court date in June how will the court go about this if he doesn’t show up to court ?

Q: Louisiana 50/50 custody agreement with child support listed on court documents to end on 18th birthday.

Child will graduate 6 months after 18th birthday. Do I have to pay until graduation? We have a agreed upon end date of the 18th birthday listed on the signed court documents.

You have to pay until graduation, if still shy of 19th birthday. Parents cannot abridge the rights of the child to receive support under statute.

On going child support ends at 18 or high school graduation, whichever comes last but not later than 19th birthday. However, arrears still due for 10 years.

Yes by the recipient. But the state won't waive it.
