Q: Letter for license being suspended for no proof of insurance.

My son was ticketed for running a red light. He couldn’t find his insurance card at the time of the stop and now has received a letter stating his license will be suspended for 30 days. He can prove he had insurance, he’s never had a lapse in insurance and he has a clean driving record. If he... View More

Sounds to me as if he must’ve plead guilty to the charge. He will have to seek a plea withdrawal to avoid the suspension period. He should contact an attorney for help.

Q: Is there a way to remove or request to remove the "Violate Restriction of DL" from my records for MN drivers?

I got a ticket for "VIOLATE RESTRICTION OF DL" for driving on Instruction permit only without the presence of License holder in car. I had the valid insurance though and it happened 1 years back. I already paid the fine but i want it removed from my records now. Is there a way to get it removed?

Paying the fine is the equivalent of a guilty plea to the charge. Getting it off of your driving record would require that you pursue an expungement.

Q: Is there a statue of limitation on how long the police officer has to file a speeding ticket?

My son got a speeding ticket in May for going 40 in a 30 in MN. When trying to pay it the court house could not find it. We had waited the 7 business days. We also called the number that it gives on the paper citation and they couldn’t find it either. We called the court house again and they... View More

Usually three years, under Minnesota Statutes Section 628.26. But in my view, everyone should always fight every speeding ticket. Why not? What's the worst that can happen? It goes on your driver's license record. The only possibility of preventing that is by fighting it. If he has... View More

No. An error on the ticket will not result in it being dismissed. But there might be other reasons to keep it off your record.

Q: I got a speeding ticket in Hennipen Co., MN, for 88 in a 55 mph zone. What are the penalties I’m facing?

The “Endangering life and property” box is marked, and have to appear in court because it was over 30 mph over the speed limit. What kind of fine am I looking at? Am I in danger of having my license revoked? This is my 2nd ticket in 11 months, 1st of this magnitude.

Check to see if it is charged as a misdemeanor. A misdemeanor is a crime with a maximum 90 day jail sentence. Jail is rare for speeding, however. A person's driver's license can be revoked or suspended as a "habitual violator," based on the number of driving violations within... View More

I'm not sure what "unclaimed" means. But, the Minnesota Department of Public Safety administers drivers licenses in Minnesota. If you call a "Driver Evaluator" there, they should be able to help you sort it out. Another idea: if you have the citation number, go to the... View More

Drivers licenses in Minnesota are administered by the Minnesota Department of Public Safety. You can call a "Driver Evaluator" there to discuss what's up with your license and whether they sent a notice. And you can go there to get a certified copy of your driver's license... View More

Q: I got a ticket in Dakota County for 106mph in a 55mph, i went to court and it was dropped to a petty misdemeanor & 99mph

The court stated that having it dropped to 99mph and a petty misdemeanor, that it would mean that the state DMV would not revoke my license for 6 month. No previous moving violations on my record. I just got pulled over for having a revoked license upon a trooper running my plate. He stated the DMV... View More

It can be a few weeks or possibly a few months before you receive notification of charges in the mail. The complaint and court date will be mailed to the address on your license. If your mail is being properly forwarded to another address, you should receive it through USPS. You can also monitor... View More

Q: issued a citation for speeding shortly after crossing a state border and entering Minnesota where speed limits vary.

Our speed limits change from 55, 60 or 65. If the location listed on the citation isn’t accurate how can he defend himself in court to prove otherwise? Would this be grounds to void the citation?

Not listing the location is not necessarily fatal to a citation so long as it indicates where - as in town/township and county where the offense occurred. Along with the citation there will be police reports and likely squad video as well which are more specific about the location where the... View More

I'm not quite sure what the question is here. But, a person charged with a traffic violation should fight it in court. Most people wish to prevent a conviction, which could trigger consequences such as temporary revocation of driver's license.

That is not going to be a silver bullet. Those sort of errors occur and don’t mean that the state can’t prove you guilty. The traffic stop is likely on a dash cam and will show what kind of vehicle you are driving.

Yes. The statute of limitations period on Minnesota drug crimes is generally three years. While an arrest is inconvenient, a prosecutor can charge a crime regardless of whether the person was ever arrested. They do need evidence. Did you? The usual problem with charging a crime against someone with only camera evidence is lack of identification evidence. The police would need to get the suspect or target to talk to them, in order to have a solid case.
