For a speeding ticket. I was on my way to work cause I had to watch my 3 month old son until his momma got home so I was running late. I got into the left lane and the road split ahead and their was a line of cars I had to get infront of so I didnt miss my turn. So I sped up enough to get infront... View More

That depends upon more of the details of the ticket, including how much over the limit, and where it was. Crim/Traffic/Mandatory basically means it isn't a civil matter.
I took a speeding ticket to court via Zoom. An accused before me was took a speeding reduction from 75 to 65 in a 60 zone. While I was waiting for my turn, I noticed on the MNCIS that the previous conviction was sent to DPS. When my turn came up, I was offered a similar reduction plea (69-60), but... View More

It does not get reported to DPS so long as you plead guilty to nine (or less) over the speed limit and you do not have a commercial license.
I was stopped by a state trooper for speeding and was issued a ticket for 9 mile over the limit, noting that the trooper claimed I was going faster.. I have a clean driving record and do not want a conviction. I am unemployed due to COVID and cannot afford a lawyer. If I contest this hoping to get... View More

It is unlikely that the prosecutor would amend the ticket simply because you set the matter on for a court hearing to try and keep the matter off of your record. However, I would expect that if you were unable to resolve the matter and it was set for trial that the ticket could be amended.
I recieved 2 tickets for driving after suspension one in 2011 and one in 2012. I have a feeling i paid them but do not have any proof of payment. I also had a judegement against me which now has expired and received a letter from the lawyers office that they are not going to reinstate the... View More

I got pulled over tonight the officer thought I was going to fast. He did not tell me how fast he did not know. He said I would be getting something in the mail. He did not explain what I would be getting. Seems a little off to me.

Yes, you can get a ticket in the mail. It happens all the time. However, it does seem unusual that he wouldn’t tell you how fast you were speeding. Look for the ticket in the mail and the contact an attorney.
Were off until he initiated the stop. He also said my speed was between 70-75mph and never gave me a definite speed . The he said he would bring it down to 65mph. Would either of these things help my case against the speeding ticket he gave me?

Those facts alone don't sound like enough for a defense win. But when we work up a defense case, we seek every fact. Then we analyze all the facts for potential defenses that could win the case. If the your goal is to keep it off your driver's license record, and if the officer... View More

Twenty-seven days isn’t a violation of any statute of limitations. But the errors might help you if you contest the ticket.
I have been driving 7+ years and this is my first offense. I was on the highway and the speed limit was 70mph.

The decision to offer a CFD is up to the prosecuting attorney. CFDs are far less common outside the metro and the likelihood that a CFD would be offered when you were 19 mph over the speed limit is unlikely unless there is some evidentiary issue in the case. You might be able to negotiate the... View More
I was going 26 over and would like to know if I am eligible for a continuance for dismissal on my ticket
answered on Jul 17, 2020
Anyone is eligible for a CFD, but given that you were 26 over, it is incredibly unlikely that you would receive a CFD unless there are serious evidentiary issues with the government's case against you. It also depends on your driving record as well. You don't indicate in your question... View More
because his probable cause was speed he never gave me ticket for speeding?does that make his other tickets against me n case illegal in court?
answered on Jul 13, 2020
Unfortunately, no. The officer may use your speed to provide a reason to stop you and ultimately decide not to cite you for it. His decision not to cite you for your speed does not invalidate the marijuana possession ticket.

Correct. But just paying the ticket is the same as a guilty plea and you will end up with a conviction.
Does an issuing officers name have to be on a citation to make it legal? I did not get the officer's name and it is not in the 'name' block of the citation. The trooper's badge number is. Can a state trooper legally give a speeding citation on a county road? This occurred in... View More

In general, typos and irregularities on a citation can be fixed later by a prosecutor. As for jurisdiction issues, those sometimes can create an opportunity for a defense win. But that will depend upon the facts and circumstances in the case. I like the fighting spirit! If possible, get help... View More
I thought I was suspended but it says on driver and vehicle services that I’m valid. Is that what law enforcement see’s if they check the status of my dL?
answered on Jun 9, 2020
Law enforcement is going to see what shows on the DVS website. As far as I am aware it is the same database.
He stated that he passed me going the opposite direction about 2 miles back. So do I have to pay the ticket since he turned around and had to speed to catch up to me 2 miles later?
answered on Jun 2, 2020
A person given a traffic citation by a Minnesota police officer must respond to it; or be convicted and fined by default. One way to respond is to pay the ticket, which amounts to a guilty plea as well. The other way to respond is to contact the court to make arrangements to be heard in court.... View More
No probation officer. If I get no tickets in a year it wont go on my record. Will the ticket in NE violate my MN stay of judication?
answered on May 24, 2020
Yes. But depending on timing and other factors, luck might favor you. There would be more incentive to delay and fight the NE ticket, in that situation, with or without a lawyer in NE.
We didn't see any no trespassing signs and we weren't planning on causing any damage, so we went in to explore a piece of history. However, the cops showed up and we all received citations. Is there such thing as a trespassing citation and were we even breaking the law by exploring the... View More

Of course there is such such thing as a trespassing citation. Whether what you did qualifies as trespassing is a different question. Was the building locked? Was it posted? Did you refuse to leave after being asked to? There are a lot of other questions here that need answering. You should... View More
I was stopped by a MN state trooper for speeding (69mph in a 60 zone, noting that the Trooper reduced it from 74). I won't answer all of those questions here. Instead, I invite your personal phone call to discuss. I will offer a couple tips here, though. Most people don't want a speed conviction on their driver's license record. The two most common results that fit that bill are: 1)... View More
Cop was driving in the opposite direction and made a U-turn. By the time he flashed his lights, the speed limit had changed from 35 to 45 after a right turn. He claimed I was going 50 in a 35 (before the right turn), but I'm sure I wasn't going more than 45. He did end up giving me a... View More

The CFR would keep it off of your record. That seems like a reasonable disposition. There is no guarantee that taking the matter to court will get you a better result. The COVID-19 issues will not have any effect whatsoever on things. Court dates are simply being delayed because of the... View More
As well as it said I was 5’ 51” tall my question is do I have to pay the ticket since he said I was not speeding?
answered on Apr 20, 2020
This is likely a typo. It would be unwise to ignore this. You should have an attorney monitor this and see if it can be dismissed.
I didn’t know about the ticket or about him paying the ticket until weeks later and only by looking at his bank statement. Being that he is 16 and I own the vehicle and pay the insurance shouldn’t I have been notified? Especially befor he admitted guilt by paying the fine
answered on Apr 17, 2020
No. It’s his ticket and he was the driver. You certainly have the option of cancelling his insurance and taking away his DL.
