I'm sorry to hear about your terrible experience. First, jot down who says what and what happens. You have some time so first thing is to get your child on the path to recovery. Do not mention to anyone that you are thinking of suing --many doctors will be shy of treating your child if they... View More
Home I started to bleed and rushed to the emergency room where it was determined that I had an arterial bleed. The doctors at the hospital said I should not have been sent home with that. They said someone should have seen it and fixed it before discharge. Is this malpractice or neglect?

Sounds like it. Fortunately you got to someone in time so this may be one of the thousands of "freebies" the medical profession gets each year--cases where the carelessness is caught in time before lasting harm happens, so the case is not worth the $30,000 or more it costs to handle a... View More

During a DOT physical the appointed DR touched me in a very inappropriate way... I feel very shamed by the way I was touched and humiliated at work by reporting the issue... now no attorney wants to discuss my claim with me... what is going on??

If not lawyer wants to take on your claim it is because they do not see any money in it. In other words, the potential value of the case is too low for their involvement. That's what's going on.

is it from the date of the malpractice, the date it started, the time when I realized it, or from the time the physical problems started as a result of medical neglect?

2 years from the date of the alleged malpractice. There is a discover rule though which may extend this to the time of discovery. Examples may be having surgery and the doctor leaves a sponge or medical instrument inside you - in such case you would have no reason to know until some other event... View More

I assume your attorney has provided you with a copy of the expert's report. Why don't you... View More
