Q: Hi, I'm 14 how do I remove custody from my mom and give my dad full custody?

I don't want to spend any money. I don't have any. My mom doesn't want to loose custody but I want my dad to have full custody. I'm currently living with my dad.

What county are you in? Contact the Guardian Ad Litem's office for your county or contact DCFS for your county and ask to speak to a public Guardian Ad Litem and they will send you in the right direction.

Q: Do i need to provide my 2 sons with their own bedroom for when i have them for 2 nights every other weekend?

I wouldn't think so, but I'm guessing the custodial parent is demanding it. File a motion with the court that entered the custody order, asking that this specific question be decided.

Q: My wife took my child out of state, filed for divorce. Could the court make her live in Utah so I can see my child?

The child is 2 months old and I would like to be able to hold her and feed her and those sorts of things.

It depends on what your child parenting plan is and visitation. If you want visitation, it's best to consult an attorney and see what your best options are in getting your visitation rights.

A judge can issue a no contact order based on a criminal circumstance or a civil petition from the other party for similar criminal allegations.

Q: In the state of Utah: I have 401K funds and IRA funds from before I was married. Are these all mine?

After I was married in 2002, I rolled all my pre-marital 401K and IRA funds into a new IRA that I set up. Later, about 2008, I rolled a post-marital 401K into the same IRA account. Does my husband get half of my pre-marital IRA/401K funds?

If you earn anything before the marriage it is yours. However, if you co-mingle marital funds with pre-marital funds your spouse may have a legal argument to make a claim. It would be good to contact an attorney to help you see the way your account is setup and protect your pre-marital assets.

Q: Can you change your child support amount if you have children more often that stated in divorce decree?

My husbands divorce decree states he has his two boys 4 nights a month and that's what his child support is based on. For the past 5 yrs we have had them 13-15 nights per month. Can we get the child support changed to reflect having them about half the time?

Yes, you can. Of course you, would need to follow current eviction laws to do so. I recently helped a mother evict her daughter who was emotionally and physically abusive.
